{"data":{"id":"us-ky/krs-109.120","jurisdiction":"us-ky","citation":"KRS 109.120","heading":"Rules and regulations of board -- Different provisions for rulemaking","body":"in those counties containing a consolidated local government  and those\ncounties that do not.\n(1) In counties not containing a consolidated local government, the board may\nadopt such rules and regulations as are necessary to carry out the purposes\nfor which the waste management  district was created and necessary for the\nadequate management  of solid waste in a manner adequate to protect the\npublic health and consistent with such rules and regulations as may  be\npromulgated by the department.\n(2) In  counties containing a  consolidated local government, all rules and\nregulations of the solid waste management  district enacted from adoption of\nthe most recent solid waste management  plan prior to March 21, 2017, shall\ncontinue in full force and effect until the later of August 31, 2017, or the date on\nwhich a new solid waste management  plan is approved by the department.\n(3) In counties containing a consolidated local government, the board may adopt\nsuch rules and regulations as are necessary to carry out the purposes for\nwhich  the waste management  district was  created and necessary for the\nadequate management  of solid waste in a manner adequate to protect the\npublic health and consistent with such rules and regulations as may  be\npromulgated by the department. These rules and regulations shall not be\nenforceable within the boundaries of the city until approved by the legislative\nbody  of the city or, if outside of an incorporated municipality, the legislative\nbody  of the consolidated local government, where the rule or regulation is\nintended to apply. A city shall approve any rule or regulation if rejecting it would\ncause the city to be in violation of its approved solid waste management  plan\nadopted in accordance with the provisions of KRS 224.43-340 and 224.43-345.\n(4) In counties containing a consolidated local government, a solid waste district\nshall be required to electronically make available on a Web  site operated by\nthe consolidated local government, all notices, meeting agendas, and meeting\nminutes.","path":["KRS Chapter 109"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45583","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:11Z","sha256":"a858f5ac8f273f018d012a68106d3c2fe0fda9c982245e8db88e434f15c2dabb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-109.115","next":"us-ky/krs-109.130"},"notice":"GroundRules: Original legal text.
