{"data":{"id":"us-ky/krs-109.260","jurisdiction":"us-ky","citation":"KRS 109.260","heading":"City providing solid waste management services pending implementation","body":"of approved plan.\n(1) No provision of this chapter shall preclude a city from providing solid waste\nmanagement services pending implementation of the approved solid waste\nmanagement plan submitted by a county or district pursuant to KRS 224.43 -340.\nAny county or waste management district that includes the provision of solid waste\nmanagement services to a city in its approved solid waste management plan shall\nprovide the city with written notice at least one (1) year prior to the date it intends to\nprovide such service to the city.\n(2) A city may be delegated the responsibility for providing solid waste management\nservices by a county where it is mutually advantageous to do so, and bot h the city\nand county agree to the delegation of authority. Upon delegation of responsibility, a\ncity acting by and through its legislative body may plan, initiate, acquire, construct\nand maintain solid waste management facilities and promulgate rules and\nregulations with respect thereto in accordance with this chapter.\n(3) Any solid waste management plan submitted by a county or district pursuant to\nKRS 224.43-340, that includes any city that has made a financial commitment for a\nsolid waste management sys tem, shall include provisions for insuring sufficient\nrevenues to the city to retire the debt on said system in accordance with the financial\nobligations incurred by the city.","path":["KRS Chapter 109"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=27282","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:11Z","sha256":"de4a73b1c3bd29a417573d46e059e646ebe24092d4b974c174911e41fc824b3a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-109.250","next":"us-ky/krs-109.270"},"notice":"GroundRules: Original legal text.
