{"data":{"id":"us-ky/krs-109.270","jurisdiction":"us-ky","citation":"KRS 109.270","heading":"Establishment of district by citizen petition and election -- Election on plan","body":"-- Dissolution or modification of districts.\n(1) When the citizens of a county desire to have such county establish a solid waste\nmanagement plan and as of January 1, 1984, the fiscal court has failed to establish a\nplan, a number of citizens equivalent to ten percent (10%) of the votes cast in the\ncounty for the office receiving the greatest total vote at the last general election,\nshall file a petition in the county of the ir residence asking that a solid waste\nmanagement plan be established.\n(2) The petition shall be filed with the county judge/executive asking that the\nproposition of establishing a solid waste management plan for the county be\nsubmitted to the voters of th e county at the next general election held in the county.\nEach voter signing the petition shall state his full name and address.  Upon the filing\nof the petition with the county judge/executive he shall enter an order directing that\nthe petition be publish ed in full pursuant to KRS Chapter 424, and shall further\nenter an order with the county clerk not later than the second Tuesday in August\npreceding the general election to have placed before the voters at such election the\nquestion, \"Are you in favor of h aving the county establish a solid waste\nmanagement plan?\" with proper spaces in which the voter may indicate a \"Yes\" or a\n\"No\" vote. If the majority of those voting on the proposition vote \"Yes,\" a solid\nwaste management plan shall be developed. The vote shall be canvassed and\nreturned by the board of election commissioners for the general election.\n(3) The result of any election with respect to establishing a solid waste management\nplan shall be certified to the fiscal court of the county, and the fiscal court shall, if\nthe result of the election is certified as in favor of the establishment of the plan,\nproceed to develop a solid waste management plan for the county.\n(4) At the next general election held in the county following the vote of the people in\nfavor of the establishment of a solid waste management plan, the county shall\nsubmit to the voters of the county the details of said plan, including the area to be\nserved, the debt to be incurred, any fees or assessments to be levied or other\nfinancing prop osals. At least thirty (30) days prior to said election the county\njudge/executive shall enter an order directing that the details of the solid waste\nmanagement plan be published pursuant to KRS Chapter 424, and shall further\nenter an order not later than the second Tuesday in August preceding the general\nelection directing the county clerk to have placed before the voters at such election\nthe question, \"Are you in favor of the implementation of the solid waste\nmanagement plan proposed by the county?\" with proper spaces in which the voter\nmay indicate a \"Yes\" or a \"No\" vote. If the majority of those voting on the\nproposition vote \"Yes,\" the solid waste management plan shall be implemented.\nThe vote shall be canvassed and returned by the board of election com missioners\nfor the general election.\n(5) The result of any election with respect to a solid waste management plan shall be\ncertified to the fiscal court of the county, and the fiscal court shall, if the result of\nthe election is certified as in favor of the plan, forthwith proceed to put the plan into\neffect. If the result of the election is against the implementation of that solid waste\nmanagement plan, the county shall proceed to develop another plan to be submitted\nto the voters of the county at the next  general election, following the procedure set\nforth in subsection (4) of this section.\n(6) The result of any election with respect to establishing a waste management district\nshall be certified to the fiscal court of the counties composing the district to  be\nestablished, and the fiscal court shall, if the result of the election is certified as in\nfavor of the establishment of the district, forthwith proceed to declare the county or\ncounties a district for the purposes of waste management, and shall proceed  to put\nthe district into effect in the same manner as they are authorized to do upon their\nown initiative.\n(7) Waste management districts created under this section may be dissolved or\nmodified pursuant to the provisions of KRS 65.166 to 65.176.","path":["KRS Chapter 109"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=27283","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:11Z","sha256":"96dcadef3fd212c51818283b656539804443332fb973b868432767c421132a0d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-109.260","next":"us-ky/krs-109.280"},"notice":"GroundRules: Original legal text.
