{"data":{"id":"us-ky/krs-116.025","jurisdiction":"us-ky","citation":"KRS 116.025","heading":"Eligibility to vote.","body":"(1) Every person who is a citizen of the United States, a resident of this state, and\na resident of the precinct in which he or she offers to vote on or before the day\npreceding the closing of the registration books for any primary, general, or\nspecial election, who possesses on the day of any election the qualifications\nset forth in Section 145  of the Constitution, exclusive of the durational\nresidency requirements, who is not disqualified under that section or under any\nother statute, and who is registered as provided in this chapter, may vote for all\nofficers to be elected by the people and on all public questions submitted for\ndetermination at that election, in the precinct in which he or she is qualified to\nvote. Any person who shall have been convicted of any election law offense\nwhich is a felony shall not be permitted to vote until his or her civil rights have\nbeen restored by executive pardon.\n(2) Any person charged with or indicted for a crime, whether or not in custody for\nsame, who has not yet been convicted of the offense and who is not otherwise\nineligible to vote, may vote for all offices to be elected by the people and on all\npublic questions submitted for determination at that election, in the precinct in\nwhich he or she is qualified to vote.\n(3) A  registered voter who changes his or her place of residence from one (1)\nprecinct to another within the same  county while the registration books are\nclosed shall be permitted to update the voting records and to vote in the\npresent election at the appropriate precinct for the current address as set forth\nin KRS 116.085(3).\n(4) Notwithstanding any provision of law to the contrary, any registered voter who\nchanges his or her place of residence from one (1) precinct to another within\nthe same county prior to the closing of the registration books and who fails to\ntransfer his or her registration with the county clerk prior to the date the\nregistration books are closed shall be permitted to vote in the present election\nat the appropriate precinct for the current address as set forth in KRS\n116.085(2).\n(5) Any registered voter who changes his or her place of residence to a different\ncounty while the registration books are closed shall be permitted to vote at the\nappropriate precinct for his or her former residence in the present election and\nshall thereafter transfer his or her voter registration.\n(6) Any registered voter who changes his or her place of residence to a different\ncounty and fails to register to vote in the county of current residence prior to the\ndate the registration books are closed shall not be eligible to vote in the present\nelection in the county of current residence or the county of former residence.\n(7) Any registered voter who changes his or her place of registration to a different\nstate while the registration books are closed in the new state of residence\nbefore a presidential election shall be permitted to cast an absentee ballot for\nPresident and Vice President only, notwithstanding subsection (1) of this\nsection, by mail or at the county clerk's office of the former residence or other\nplace designated by the county board of elections and approved by the State\nBoard of Elections.","path":["KRS Chapter 116"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52121","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:11Z","sha256":"a24cdb208b178a35be443eadce1ff2941f4e09749ae9547e3cbbb3d6d13d08b0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-116.020","next":"us-ky/krs-116.030"},"notice":"GroundRules: Original legal text.
