{"data":{"id":"us-ky/krs-116.048","jurisdiction":"us-ky","citation":"KRS 116.048","heading":"Voter registration agencies.","body":"(1) The following agencies are designated as voter registration agencies in accordance\nwith the National Voter Registration Act of 1993:\n(a) Agencies that provide benefits under public assistance under Title IV-A of the\nFederal Social Security Act, the Special  Supplemental Food Program for\nWomen, Infants, and Children, the Kentucky Medical Assistance Program, or\nthe Food Stamps Program;\n(b) Armed Forces recruitment offices;\n(c) Other agencies as the Secretary of State shall determine to be providing public\nassistance; and\n(d) Other agencies as the Secretary of State shall determine to be state -funded\nprograms primarily engaged in providing services to persons with disabilities.\n(2) A voter registration agency that provides service or assistance in conducting vot er\nregistration shall:\n(a) Distribute with each application for its service or assistance, and with each\nrecertification, renewal, or change of address form, the office's own voter\nregistration application form that complies with the requirements of Sectio n 7\nof Public Law 103-31, the National Voter Registration Act of 1993;\n(b) Provide a form that includes:\n1. The question, \"If you are not registered to vote where you live now,\nwould you like to apply to register to vote here today?\";\n2. If the agency prov ides public assistance, the statement, \"Applying to\nregister or declining to register to vote will not affect the amount of\nassistance that you will be provided by this agency.\";\n3. Boxes for the applicant to check to indicate whether the applicant would\nlike to register or declines to register to vote (failure to check either box\nbeing deemed to constitute a declination to register for purposes of\nparagraph (c) of this subsection), together with the statement in close\nproximity to the boxes and in prominen t type, \"IF YOU DO NOT\nCHECK EITHER BOX, YOU WILL BE CONSIDERED TO HAVE\nDECIDED NOT TO REGISTER TO VOTE AT THIS TIME.\";\n4. The statement, \"If you would like help in filling out the voter\nregistration application form, we will help you. The decision whether  to\nseek or accept help is yours. You may fill out the application form in\nprivate.\"; and\n5. The statement, \"If you believe that someone has interfered with your\nright to register or to decline to register to vote, you r right to privacy in\ndeciding whether to register or in applying to register to vote, or your\nright to choose your own political party or other political preference, you\nmay file a complaint with __________________.\", the blank being filled\nby the name, a ddress, and telephone number of the appropriate official\nto whom a complaint should be addressed; and\n(c) Provide to each applicant who does not decline to register to vote the same\ndegree of assistance with regard to the completion of the registration\napplication form as is provided by the office with regard to the completion of\nits own forms, unless the applicant refuses assistance.\n(3) (a) At each voter registration agency, the following services shall be made\navailable:\n1. Distribution of mail voter registration forms;\n2. Assistance to applicants in completing voter registration application\nforms, unless the applicant refuses assistance; and\n3. Acceptance of completed voter registration application forms for\ntransmittal to the county clerk of the county of the applicant's voting\nresidence.\n(b) If a voter registration agency designated under subsection (1)(d) of this section\nprovides services to a person with a disability at the person's home, the agency\nshall provide the services described in paragraph (a ) of this subsection at the\nperson's home.\n(4) A person who provides services described in subsection (3) of this section shall not:\n(a) Seek to influence an applicant's political preference or party registration;\n(b) Display any material indicating the pe rson's political preference or party\nallegiance;\n(c) Make any statement to an applicant or take any action the purpose or effect of\nwhich is to discourage the applicant from registering to vote; or\n(d) Make any statement to an applicant or take any action the purpose or effect of\nwhich is to lead the applicant to believe that a decision to register or not to\nregister to vote has any bearing on the availability of services or benefits.\n(5) The State Board of Elections may designate requirements for record ke eping and\ndocument retention it deems necessary to comply with the National Voter\nRegistration Act of 1993 and the provisions of this chapter.\n(6) (a) A completed registration application accepted at a voter registration agency\nshall be transmitted to the county clerk of the county of the applicant's voting\nresidence or the State Board of Elections not later than ten (10) days after the\ndate of acceptance.\n(b) If a registration application is accepted within five (5) days before the last day\nfor registration to vote in an election, the application shall be transmitted to\nthe county clerk of the county of the applicant's voting residence or the State\nBoard of Elections not later than five (5) days after the date of acceptance.","path":["KRS Chapter 116"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=27303","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:11Z","sha256":"84caa431dd654f2e96b8a6bf1876230ac5bb1da17abe244ff89631764b806356","source_id":"us-ky","stale":false,"prev":"us-ky/krs-116.047","next":"us-ky/krs-116.049"},"notice":"GroundRules: Original legal text.
