{"data":{"id":"us-ky/krs-116.113","jurisdiction":"us-ky","citation":"KRS 116.113","heading":"Removal of voter's name by state board upon notice of death, declaration","body":"of incompetency, excusal from jury duty due to not being a citizen of the\nUnited States, conviction of felony, or out -of-state registration -- Notice to\ncounty clerk.\n(1) (a) Upon receipt of notification from the Cabinet for Health and Family Services\nor other reliable sources of the death of a person, the State Board of Elections\nshall within five (5) days cause the removal of the name of that person from\nthe voter registration records it maintains, except that no voter's name may be\nremoved during the period of time the registration books are closed for any\nprimary, general, or special election.\n(b) To ensure that the State Board of Elections accurately removes n ames from\nthe voter registration records it maintains, the Cabinet for Health and Family\nServices shall provide a copy of the lifetime Kentucky death records to the\nState Board of Elections on or before July 1 of each year.\n(2) Upon receipt of notification  from the circuit clerk that a person has been declared\nincompetent, the State Board of Elections shall within five (5) days cause the\nremoval of the name of that person from the voter registration records it maintains,\nexcept that no voter's name may be r emoved during the period of time the\nregistration books are closed for any primary, general, or special election.\n(3) Upon receipt of notification from the Administrative Office of the Courts that a\nperson has been excused from jury duty for not being a ci tizen of the United States,\nthe State Board of Elections shall within five (5) days cause the removal of the\nname of that person from the voter registration records it maintains, except that no\nvoter's name may be removed during the period of time the regi stration books are\nclosed for any primary, general, or special election.\n(4) Upon receipt of notification from the Administrative Office of the Courts or the\nUnited States Department of Justice that a person has been convicted of a felony\noffense, including persons convicted of a felony offense whose case is currently on\nappeal, the State Board of Elections shall within five (5) days cause the removal of\nthe name of that person from the voter registration records it maintains, except that\nno voter's name ma y be removed during the period of time the registration books\nare closed for any primary, general, or special election.\n(5) Upon receipt of notification from a local or state jurisdiction that a voter has\nregistered to vote in the new local or state jurisd iction outside of the\nCommonwealth, the State Board of Elections shall within five (5) days cause the\nremoval of the name of that person from the voter registration records that it\nmaintains, except that no voter's name may be removed during the period of time\nthe registration books are closed for any primary, regular election, or special\nelection.\n(6) (a) Following the purge of a name from the records of the State Board of\nElections:\n1. The state board shall notify the clerk of the county in which the vote r\nlived of the action; and\n2. The county clerk shall within ten (10) days update the county voter\nregistration files to reflect the necessary change.\n(b) 1. If a protest is filed by the voter, the county board shall hear it at its next\nregular monthly meeting.\n2. If the county board decides in favor of the protesting voter, the voter's\nregistration record shall be restored, including his or her voting record.\n3. If the protest is filed while the registration books are closed and the\ncounty board decides in favor of the protesting voter, the county board\nshall issue the voter an \"Authorization to Vote\" for the upcoming\nelection and the voter's record shall be re stored when the registration\nbooks open following the election.","path":["KRS Chapter 116"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58059","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:11Z","sha256":"fee5d05a5a3767b983b773e29acd7e676c6d1a3b2d4b37a0d53a612269542fec","source_id":"us-ky","stale":false,"prev":"us-ky/krs-116.112","next":"us-ky/krs-116.114"},"notice":"GroundRules: Original legal text.
