{"data":{"id":"us-ky/krs-117.020","jurisdiction":"us-ky","citation":"KRS 117.020","heading":"Declaration by state board of county's status as a preclearance county.","body":"The State Board of Elections may declare a county to be a preclearance county for\nelection purposes when that county has a history of voter fraud, noncompliance with\nelection laws, or voter complaints about the integrity of a particular election. In a coun ty\ndesignated as a preclearance county, all decisions of the county board of elections shall be\nreported to the State Board of Elections for its review. The failure of a county board of\nelections of a preclearance county to submit its decisions to the Stat e Board of Elections\nfor its review shall constitute a prima facie case for appointment of an election manager\nunder KRS 117.022. The State Board of Elections may require a preclearance county to\nsubmit evidence or justification as required by the state bo ard which is necessary to\nevaluate the county board's decisions.
