{"data":{"id":"us-ky/krs-117.0553","jurisdiction":"us-ky","citation":"KRS 117.0553","heading":"Review and approval of precinct establishment order -- Resubmission of","body":"returned orders.\n(1) The executive director of the State Board of Elections or his designee shall examine\neach proposed precinct establishment order submitted under KRS 117.0552 t o\ndetermine if the order would establish precincts in compliance with KRS 117.055 to\n117.0552.\n(2) If the executive director or his designee determines that the proposed precinct\nestablishment order would comply with KRS 117.055 to 117.0552, the executive\ndirector shall approve the proposed precinct establishment order no later than thirty\n(30) days after its receipt by the executive director. The order shall become effective\nupon the executive director's approval unless the order contains a different effec tive\ndate.\n(3) If the executive director or his designee determines that the proposed precinct\nestablishment order would not comply with KRS 117.055 to 117.0552, the\nexecutive director shall return the proposed precinct establishment order to the\ncounty bo ard of elections no later than thirty (30) days after he receives the\nproposed order. The order shall be accompanied by a letter from the executive\ndirector indicating specifically how the order would not comply with KRS 117.055\nto 117.0552.\n(4) If a proposed precinct establishment order is returned to a county board of elections\nunder this section, the board may:\n(a) Amend the proposed order so that the precincts may be established in\ncompliance with KRS 117.055 to 117.0552; or\n(b) Request an exemption under KRS 117.0554; or\n(c) Request a hearing under KRS 117.0555.\n(5) The county board of elections shall resubmit the proposed order to the executive\ndirector of the State Board of Elections with the amendment, request for an\nexemption, or request for a heari ng.
