{"data":{"id":"us-ky/krs-117.0861","jurisdiction":"us-ky","citation":"KRS 117.0861","heading":"Persons who may exercise control over mail-in absentee ballots.","body":"(1) No person shall knowingly collect, gain possession of, deliver, or exercise control\nover a mail-in absentee ballot, except for:\n(a) A voter personally casting his or her bal lot by means of mail -in absentee\nballot;\n(b) An election official engaged in official duties as prescribed in KRS Chapters\n116 to 120;\n(c) A United States Postal Service worker or any other person who is allowed by\nlaw to transmit United States mail if the  worker or other person is engaged in\nofficial duties;\n(d) A family member of the voter:\n1. Who shall be related to the voter as set forth in KRS 6.611(16)(a), or as\nestablished by marriage, adoption, or legal guardianship; and\n2. Who is designated by the voter to assist in the mail -in absentee voting\nprocess;\n(e) A person:\n1. Who shares the same residence of the voter; and\n2. Is designated by the voter to assist in the mail -in absentee voting\nprocess;\n(f) A caregiver or employee:\n1. Who provides medical or healthcare assistance to the voter in a\nresidence, nursing care institution, hospice facility, assisted living\ncenter, assi sted living facility, assisted living home, residential care\ninstitution, adult day healthcare facility, or adult foster home; and\n2. Who is ordinarily engaged in duties related to the receiving and\ndelivering of mail matter; and\n(g) An employee of a jail who is ordinarily engaged in official duties related to\nthe delivery of mail matter.\n(2) For subsection (1)(f) and (g) of this section, the person collecting, possessing,\ndelivering, or exercising control over a mail -in absentee ballot shall at all times\nhandle the ballot so that all information contained on the ballot remains private to\nthe voter as required by KRS 118.025(1).\n(3) For subsection (1)(d) and (e) of this section, the person designated by the voter shall\nnot have been:\n(a) Declared mentally di sabled by a court of competent jurisdiction, which\nadjudication has not been set aside; or\n(b) Convicted of an election law offense whose civil rights have not been restored\nby the Governor.","path":["KRS Chapter 117"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54640","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:12Z","sha256":"7792874a2041077e34f31c25c50220c399db3ee39c5f48b55851ea024c8c08ae","source_id":"us-ky","stale":false,"prev":"us-ky/krs-117.086","next":"us-ky/krs-117.0863"},"notice":"GroundRules: Original legal text.
