{"data":{"id":"us-ky/krs-117.379","jurisdiction":"us-ky","citation":"KRS 117.379","heading":"Examination of voting system or e -poll book product by State Board of","body":"Elections.\n(1) (a) Any person or corporation owning, manufacturing, or selling any voting\nsystem or e -poll book product may request the State Board of Elections to\nexamine the voting system or e -poll book product. Before requesting an\nexamination or reexamination, any person, persons, or corporation shall pay\nto the State Treasurer a nonrefundable deposit of five hundred dollars ($500)\nand submit a test report from an independent testing authority approved by the\nState Board of Elections.\n(b) If the report concerns a voting system, the report shall demonstrate that the\nvoting system meets a previously established Election Assistance Commission\nstandard. Notwithstanding an y other provision of law to the contrary, if an\nElection Assistance Commission standard has been amended less than thirty -\nsix (36) months prior to the request for examination under this subsection, the\nState Board of Elections may approve and certify a vot ing system that meets\nthe prior standard after determining:\n1. The effect that such approval would have on the integrity and security of\nelections; and\n2. The procedure and cost involved to bring the voting system into\ncompliance with the amended standard.\n(c) The State Board of Elections may, at any time, reexamine any voting system\nor e-poll book product already approved. The State Board of Elections shall\napprove or disapprove any voting system or e -poll book product within sixty\n(60) days after the date  of its initial submission. Any or all costs associated\nwith the voting system or e -poll book product being examined or reexamined\nshall be paid to the State Treasurer by the person or corporation once the\napproval or disapproval is complete.\n(2) (a) Upon receipt of a request for examination or reexamination of a voting system\nor e -poll book product, the State Board of Elections shall require that the\nvoting system or e-poll book product be examined or reexamined by three (3)\nexaminers. The State Board of E lections shall appoint one (1) examiner who\nis an expert in computer science, voting systems, or e -poll book products,\nwhichever is applicable; one (1) person who is knowledgeable in election\nprocedures, election security, and election law in Kentucky; and  one (1)\nperson who is a present or former county clerk. The three (3) examiners shall\nsubmit one (1) written report on each voting system or e -poll book product,\nexamined or reexamined, to the State Board of Elections. The members of the\nState Board of Elections shall also examine or reexamine the voting system or\ne-poll book product.\n(b) A voting system shall be approved and certified if the examiners' report states\nthat the voting system meets all the requirements of KRS 117.125 and\napplicable federal la w, and the State Board of Elections finds that the voting\nsystem meets all of the requirements of KRS 117.125 and applicable federal\nlaw.\n(c) Beginning September 1, 2022, an e -poll book product shall be approved and\ncertified if the examiners' report and t he State Board of Elections find that the\ne-poll book product meets the certification requirements promulgated by the\nState Board of Elections in accordance with KRS Chapter 13A and applicable\nfederal law.\n(d) Each report and letter of approval pertaining to a voting system or an e -poll\nbook product shall be filed in the office of the State Board of Elections.\n(3) Any voting system or e -poll book product not approved by the State Board of\nElections shall not be used at any primary, regular election, or special election.\n(4) When a voting system or e -poll book product has been approved, any improvement\nor changes in the voting system or e -poll book product shall render necessary the\nexamination or approval of such voting system or improvement.\n(5) Neither the members of the State Board of Elections, nor any examiner appointed\nby the State Board of Elections, nor any member of a county board of elections\nshall have any pecuniary interest in any voting system or e-poll book product.\n(6) Each examiner appointed by the State Board of Elections shall receive fair\ncompensation to be established by the State Board of Elections.","path":["KRS Chapter 117"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56997","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:13Z","sha256":"8e2456d1aca7ae82611bedaf6dcefc154d00c4f4e9c2830be6b2133abb1f2f18","source_id":"us-ky","stale":false,"prev":"us-ky/krs-117.377","next":"us-ky/krs-117.380"},"notice":"GroundRules: Original legal text.
