{"data":{"id":"us-ky/krs-117a.010","jurisdiction":"us-ky","citation":"KRS 117A.010","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context otherwise requires:\n(1) \"Covered voter\" means:\n(a) A uniformed-service voter or an overseas voter who is registered to vote\nin the Commonwealth  of Kentucky;\n(b) A  uniformed-service voter defined in subsection (9)(a) of this section\nwhose  voting residence is in the Commonwealth  of Kentucky and who\notherwise satisfies the Commonwealth  of Kentucky's voter eligibility\nrequirements;\n(c) An overseas voter who, before leaving the United States, was last eligible\nto vote in the Commonwealth  of Kentucky and, except for his or her\nabsence  from the state, otherwise satisfies the Commonwealth  of\nKentucky's voter eligibility requirements;\n(d) An  overseas voter who, before leaving the United States, would have\nbeen last eligible to vote in the Commonwealth  of Kentucky had the voter\nthen been of voting age and, except for his or her absence from the state,\notherwise satisfies the Commonwealth  of Kentucky's voter eligibility\nrequirements; or\n(e) An  overseas voter who  was  born outside the United States, is not\ndescribed in paragraph (c) or (d) of this subsection, and, except for his or\nher absence from the state, otherwise satisfies the Commonwealth  of\nKentucky's voter eligibility requirements, if:\n1. The last place where a parent or legal guardian of the voter was, or\nunder this chapter would have been, eligible to vote before leaving\nthe United States is within the Commonwealth  of Kentucky; and\n2. The voter has not previously registered to vote in any other state;\n(2) \"Dependent\" means  an individual recognized as a dependent by a uniformed\nservice;\n(3) \"Federal postcard application\" means  the application prescribed under the\nRegistration and Voting by Absent Uniformed Services Voters and Overseas\nVoters in Elections for Federal Office Act, 52 U.S.C. secs. 20301 to 20311;\n(4) \"Federal write-in absentee  ballot\" means  the ballot described in the\nRegistration and Voting by Absent Uniformed Services Voters and Overseas\nVoters in Elections for Federal Office Act, 52 U.S.C. secs. 20301 to 20311;\n(5) \"Military-overseas ballot\" means:\n(a) A federal write-in absentee ballot;\n(b) A ballot specifically prepared or distributed for use by a covered voter in\naccordance with this chapter; or\n(c) A ballot cast by a covered voter in accordance with this chapter;\n(6) \"Overseas voter\" means  a United States citizen who  is outside the United\nStates;\n(7) \"State\" means  a state of the United States, the District of Columbia, Puerto\nRico, the United States Virgin Islands, or any territory or insular possession\nsubject to the jurisdiction of the United States;\n(8) \"Uniformed service\" means:\n(a) Active and reserve components of the Army, Navy, Air Force, Marine\nCorps, or Coast Guard of the United States;\n(b) The  Merchant Marine, the commissioned corps of the Public Health\nService, or the commissioned  corps of the National Oceanic and\nAtmospheric Administration of the United States; or\n(c) The National Guard and state militia;\n(9) \"Uniformed-service voter\" means an individual who is qualified to vote and is:\n(a) A  member  of the active or reserve components of the Army, Navy, Air\nForce, Marine Corps, or Coast Guard of the United States who is on\nactive duty;\n(b) A member  of the Merchant Marine, the commissioned corps of the Public\nHealth Service, or the commissioned corps of the National Oceanic and\nAtmospheric Administration of the United States;\n(c) A member  on activated status of the National Guard or state militia; or\n(d) A spouse or dependent of a member  referred to in this subsection; and\n(10) \"United States,\" used in the territorial sense, means  the several states, the\nDistrict of Columbia, Puerto Rico, the United States Virgin Islands, and any\nterritory or insular possession subject to the jurisdiction of the United States.","path":["KRS Chapter 117A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48513","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:14Z","sha256":"6f7b4fb59d80c51d096343efb01364fe5690e374f96e7fd7464369193f5a6d0f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-117a.005","next":"us-ky/krs-117a.020"},"notice":"GroundRules: Original legal text.
