{"data":{"id":"us-ky/krs-117a.030","jurisdiction":"us-ky","citation":"KRS 117A.030","heading":"Powers and duties of State Board of Elections.","body":"(1) The State Board of Elections is responsible for implementing this chapter and\nthe Commonwealth  of Kentucky's responsibilities under the Registration and\nVoting by Absent Uniformed Services Voters and Overseas Voters in Elections\nfor Federal Office Act, 52 U.S.C. secs. 20301 to 20311.\n(2) The  State Board  of Elections shall have  the authority to promulgate\nadministrative regulations necessary to implement this chapter.\n(3) The  State Board  of Elections shall make  available to covered voters\ninformation regarding voter registration procedures for covered voters and\nprocedures for casting military-overseas ballots.\n(4) The State Board of Elections shall establish an electronic transmission system\nthrough which a covered voter may  apply for and receive voter registration\nmaterials, military-overseas ballots, and other information authorized under this\nchapter.\n(5) The State Board of Elections shall:\n(a) Develop standardized absentee-voting materials, including privacy and\ntransmission envelopes and their electronic equivalents, authentication\nmaterials, and voting instructions, to be used with the military-overseas\nballot of a  voter authorized to vote in any  jurisdiction in the\nCommonwealth  of Kentucky; and\n(b) To the extent reasonably possible, coordinate with other states to carry\nout this section.\n(6) The  State Board of Elections shall prescribe the form and content of a\ndeclaration for use  by  a  covered  voter to swear  or affirm specific\nrepresentations pertaining to the voter's identity, eligibility to vote, status as a\ncovered voter, and timely and proper completion of a military-overseas ballot.\nThe declaration shall be based on the declaration prescribed to accompany  a\nfederal write-in absentee ballot, as modified to be consistent with this chapter.\nThe State Board of Elections shall ensure that a form for the execution of the\ndeclaration, including an indication of the date of execution of the declaration,\nis a prominent part of all balloting materials for which the declaration is\nrequired.","path":["KRS Chapter 117A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=48514","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:14Z","sha256":"fe536c234f56b267022ec1e3248ed04eb29faa6f01debe56a8f68715448bf2d4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-117a.020","next":"us-ky/krs-117a.040"},"notice":"GroundRules: Original legal text.
