{"data":{"id":"us-ky/krs-118.015","jurisdiction":"us-ky","citation":"KRS 118.015","heading":"Definitions for chapter.","body":"As used in this chapter, unless the context otherwise requires:\n(1) \"Political party\" means an affiliation or organization of electors representing a\npolitical policy and having a constituted authority for its government and\nregulation, and whose candidate received at least ten percent (10%) of the total vote\ncast at the last preceding election at which presidential electors were voted for;\n(2) \"Election,\" used in reference to a state, district, county, or city election, includes the\ndecisions of questions submitted to the qualified voters as well as the choice of\nofficers by them;\n(3) \"Ballot\" or \"official ballot\" means the official presentation of offices and candidates\nto be voted for, including write-in candidates, and all public questions submitted for\ndetermination, and shall include a voting machine ballot, a paper ballot, an absentee\nballot, a federal provisional ballot, a federal provisional absentee ballot, or a\nsupplemental paper ballot which has been authorized for the use of the voters in any\nprimary, regular election, or special election by the Secretary of State or the county\nclerk;\n(4) \"Ballot box\" means any box, bag, or other container that can be locked, sealed, or\notherwise rendered tamper-resistant, for receiving ballots;\n(5) \"Election officer\" means any person tasked with election administration within this\nstate, as context dictates the defined role, including but not limited to the Secretary\nof State and his or her employees, members of the State Board of Elections and\nstaff, members of the county boards of election and staff, precinct election officers,\nelection officials, and poll workers;\n(6) \"Voting equipment\" means any physical component of a voting system and\nincludes voting machines where voting machines are in operation;\n(7) \"Voting machine\" or \"machine\" means a part of a voting system that consists of:\n(a) A direct recording electronic voting machine that:\n1. Records votes by means of a ballot display provided with mechanical or\nelectro-operated components that may be actuated by the voter;\n2. Processes the data by means of a computer program;\n3. Records voting data and ballot images in internal and external memory\ncomponents; and\n4. Produces a tabulati on of the voting data stored in a removable memory\ncomponent and on a printed copy; or\n(b) One (1) or more electronic devices that operate independently or as a\ncombination of a ballot marking device and an electronic or automatic vote\ntabulating device;\n(8) \"Voting system\" means:\n(a) The total combination of physical, mechanical, electromechanical, or\nelectronic equipment, including the software, hardware, firmware, and\ndocumentation required to program, control, and support that equipment, that\nis used to:\n1. Define ballots;\n2. Cast and count votes;\n3. Report or display election results; and\n4. Maintain and produce any audit trail information; and\n(b) The practices and associated documentation used to:\n1. Identify system components and versions of those components;\n2. Test the system during its development and maintenance;\n3. Maintain records of system errors and defects;\n4. Determine specific system changes to be made to a system after the\ninitial qualification of the system; and\n5. Make available any mate rials to the voter, such as notices, instructions,\nforms, or paper ballots;\n(9) \"Resident,\" used in reference to a candidate in a state, district, county, or city\nelection means actual resident, without regard to the residence of the spouse of the\ncandidate;\n(10) \"Political organization\" means a political group not constituting a political party\nwithin the meaning of subsection (1) of this section but whose candidate received\ntwo percent (2%) or more of the vote of the state at the last preceding election f or\npresidential electors; and\n(11) \"Political group\" means a political group not constituting a political party or a\npolitical organization within the meaning of subsections (1) and (10) of this section.","path":["KRS Chapter 118"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56999","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:14Z","sha256":"85ca18fb800fbbe08beaea750ec4bad63214c95c0114c87a91102852258734ea","source_id":"us-ky","stale":false,"prev":"us-ky/krs-118.010","next":"us-ky/krs-118.020"},"notice":"GroundRules: Original legal text.
