{"data":{"id":"us-ky/krs-118.212","jurisdiction":"us-ky","citation":"KRS 118.212","heading":"When candidate's name not to be certified or printed on ballot -- Effect of","body":"death, disqualification, or withdrawal of candidate -- Notice required at polls --\nPenalty.\n(1) If, before the time of certification of candidates who will appear on the ballot\nprovided in KRS 118.215, any candidate whose notification and declaration or\ncertificate or petition of nomination has been filed in the office of the Secretary of\nState dies, is disqualified, or notifies the Secretary of State in writing, signe d and\nproperly notarized, that he or she will not accept the nomination or election, the\nSecretary of State shall not certify his or her name.\n(2) If, after the certification of candidates who will appear on the ballot as provided in\nKRS 118.215, any candi date whose notification and declaration or certificate or\npetition of nomination has been filed in the office of the county clerk dies, is\ndisqualified, or notifies the clerk, in the manner described in subsection (1) of this\nsection, that he or she will n ot accept the nomination or election, the clerk shall\nensure that notice is provided to the appropriate precincts as provided in subsection\n(5) of this section.\n(3) If, after the certification of candidates who will appear on the ballot as provided in\nKRS 118.215, any candidate whose notification and declaration or certificate or\npetition of nomination has been filed in the office of the Secretary of State dies, is\ndisqualified, or notifies the Secretary of State in the manner described in subsection\n(1) of  this section, that he or she will not accept the nomination or election, the\nSecretary of State shall immediately notify the appropriate county clerk, and the\nclerk shall ensure that notice is provided to the appropriate precincts as provided in\nsubsection (5) of this section.\n(4) If, after the certification of candidates who will appear on the ballot as provided in\nKRS 118.215, any candidate whose name appears on the ballot shall officially\nwithdraw, be disqualified, or die, neither the precinct election officers nor the\ncounty board of elections shall disclose or report on the official certification of the\nvotes cast for the candidate; and, if there is only one (1) remaining candidate on the\nballot for that office in a primary election, following the with drawal,\ndisqualification, or death of the other candidate or candidates, neither the precinct\nelection officers nor the county board of elections shall disclose or report on the\nofficial certification of the votes for the remaining candidate, and the offic er with\nwhom the remaining candidate has filed his or her nomination papers shall\nimmediately issue and file in his or her office a certificate of nomination for that\nremaining candidate and send a copy to the remaining candidate.\n(5) If, after the certifi cation of candidates who will appear on the ballot as provided in\nKRS 118.215, any candidate whose name appears on the ballot shall officially\nwithdraw, be disqualified, or die, the county clerk shall provide a notice to the\nprecinct election officers who shall see that the notice is conspicuously displayed at\nthe polling place advising voters of the change, and that votes for the candidate\nshall not be disclosed or reported. If the county clerk learns of the death,\ndisqualification, or withdrawal at least five (5) days prior to the election and\nprovides the notice required by this subsection and the precinct officers fail to post\nthe notice at the polling place, the precinct officers shall be guilty of a violation\nsubject to a fine of not less than ten doll ars ($10) nor more than two hundred fifty\ndollars ($250).","path":["KRS Chapter 118"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57013","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:15Z","sha256":"bb8003b745dea54bcbfc4b99fb7ff6e44535fd5edeb54bb625fd7781c4549783","source_id":"us-ky","stale":false,"prev":"us-ky/krs-118.210","next":"us-ky/krs-118.215"},"notice":"GroundRules: Original legal text.
