{"data":{"id":"us-ky/krs-118.730","jurisdiction":"us-ky","citation":"KRS 118.730","heading":"Writ for special election for member of General Assembly -- Location","body":"where voting to be conducted when only one candidate nominated --\nExceptions.\n(1) When a vacancy exists in either house of the General Assembly during its session,\nthe presiding offi cer of the house in which the vacancy exists shall issue a writ of\nelection; when the General Assembly is not in session, the writ shall be issued by\nthe Governor. The writ shall be signed by the officer issuing it, shall designate the\nday for holding the election, and shall be directed to the proper sheriff or sheriffs.\n(2) If a writ of election has been issued to fill a vacancy in either house of the General\nAssembly and only one (1) candidate has been nominated under KRS 118.760 and\n118.770 and no candidate has filed a declaration of intent to be a write -in candidate\nfor the vacancy under KRS 117.265(2), the county clerks of the counties in the\nterritory in which the special election is to be held shall conduct voting in only one\n(1) of the following:\n(a) The county clerk's office; or\n(b) Other place or places designated by the county board of elections and\napproved by the State Board of Elections.\n(3) Subsection (2) of this section shall not apply when the writ of election calls for the\nelection to be held on either:\n(a) The day of a primary or general election; or\n(b) The same day as any other special election, except an uncontested special\nelection to fill a vacancy in either house of the General Assembly.","path":["KRS Chapter 118"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39978","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:16Z","sha256":"23d28a4806fa2c66ddc5a3357220a2034782fdb2612d538284c5f1ddd8aa6703","source_id":"us-ky","stale":false,"prev":"us-ky/krs-118.720","next":"us-ky/krs-118.740"},"notice":"GroundRules: Original legal text.
