{"data":{"id":"us-ky/krs-118a.150","jurisdiction":"us-ky","citation":"KRS 118A.150","heading":"Certification of candidates -- Ballots -- Effect of death, disqualification,","body":"or withdrawal of candidate -- Penalty.\n(1) In certification of candidates for judicial office, no reference shall be made to\npolitical affiliation.\n(2) The Secretary of State shall not knowingly certify to the county clerk of any county\nthe name of any candidate who has not filed the required nomination or candidacy\npapers, nor knowingly fail to certify the name of any candidate who has filed the\nrequired nomination or candidacy papers.\n(3) No county clerk shall knowingly cause to be printed on any ballots or absentee\nballots for any election, the name of a candidate for an office of the Court of Justice\nwho has not been certified in the manner specified in this chapter.\n(4) If, before the time of certification of candidates who will appear on the ballot\nprovided for in this chapter, any candidate whose petition or certificate of\nnomination or petition for candidacy has been filed, dies, is disqualified, or notifies\nthe Secretary of State in writing, signed and properly notarized, that he or she will\nnot accept the nomination or election, the Secretary of State shall not certify his or\nher name.\n(5) If, after the certification of candidates who will appear on the ballot , any candidate\nwhose petition or certificate of nomination or petition for candidacy has been filed,\ndies, is disqualified, or notifies the Secretary of State in the manner described in\nsubsection (4) of this section, that he or she will not accept the no mination or\nelection, the Secretary of State shall immediately notify the appropriate county\nclerk, and the clerk shall ensure that notice is provided to the appropriate precincts\nas provided in subsection (7) of this section.\n(6) If after the certificatio n of candidates who will appear on the ballot, any candidate\nwhose name appears on the ballot shall withdraw, be disqualified, or die, neither the\nprecinct election officers nor the county board of elections shall disclose or report\non the official certifi cation of the votes cast for the candidate; and, in a primary, if\nthere are only one (1) or two (2) remaining candidates on the ballot for that office,\nfollowing the withdrawal, disqualification, or death of the other candidate or\ncandidates, neither the p recinct election officers nor the county board of elections\nshall disclose or report on the official certification of the votes for the remaining\ncandidate or candidates, and the officer with whom the remaining candidate or\ncandidates has filed his or her nomination papers shall immediately issue and file in\nhis or her office a certificate of nomination for that remaining candidate or\ncandidates and send a copy to the remaining candidate or candidates.\n(7) If, after the certification of candidates who will appear on the ballot, any candidate\nwhose name appears on the ballot shall withdraw pursuant to KRS 118.212, be\ndisqualified, or die, the county clerk shall provide notices to the precinct election\nofficers who shall see that a notice is conspicuously disp layed at the polling place\nadvising voters of the change, and that votes for the candidate shall not be disclosed\nor reported. If the county clerk learns of the death, disqualification, or withdrawal at\nleast five (5) days prior to the election and provide s the notices required by this\nsubsection and the precinct officers fail to post the notices at the polling place, the\nofficers shall be guilty of a violation, subject to a fine of not less than ten dollars\n($10) nor more than two hundred fifty dollars ($250).","path":["KRS Chapter 118A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57014","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:16Z","sha256":"cd57c27800ff52dabc00585bf99eabd88523006f5212f70e27911eafa90230fb","source_id":"us-ky","stale":false,"prev":"us-ky/krs-118a.140","next":"us-ky/krs-118a.160"},"notice":"GroundRules: Original legal text.
