{"data":{"id":"us-ky/krs-118a.190","jurisdiction":"us-ky","citation":"KRS 118A.190","heading":"Issuance of certificates by State Board of Elections -- Tie votes.","body":"(1) The State Board of Elections shall issue certificates of nomination or election for all\nprimary and regular elections as provided in this section.\n(2) Following a primary or regular election, the board of elections of each county shall\nmake out duplicate c ertificates of the total number of votes received by each\ncandidate, by circuit or district, and numbered division thereof if divisions exist.\nThe certificate of the total number of votes shall be certified to the Secretary of\nState's Office not later than  12 noon, prevailing time, on the Friday following the\nprimary or regular election. The clerk shall keep one (1) of the certificates in his or\nher office and, within three (3) days of their receipt from the board, shall forward\nthe other certificate by mail to the Secretary of State who shall deliver it to the State\nBoard of Elections.\n(3) The State Board of Elections shall meet to count and tabulate the votes received by\nthe different candidates as certified to the Secretary of State no later than the thir d\nMonday after the primary or regular election. When the board certifies the results of\na primary or regular election, the right to contest the election or primary shall not be\nimpaired. A majority of the members of the board shall constitute a quorum and\nmay act. The board shall prepare the certificates of nomination or election in the\noffice of the board, from the returns made. The certificates shall be in writing and in\nduplicate, and shall be signed by the board members. The board shall forward the\noriginal certificate, by mail, to the nominated or elected candidate, unless he or she\nhas failed to comply with KRS Chapter 121. The duplicate shall be retained in the\noffice of the board.\n(4) Certificates of nomination for a judicial office shall be issued t o the two (2)\ncandidates receiving the highest number of votes, except that if more than two (2)\ncandidates are found to have received the highest and an equal number of votes for\nthe same office or if two (2) or more candidates are found to have received the\nsecond highest and an equal number of votes for the same office, the election shall\nbe determined by lot in the manner the board directs, in the presence of not less than\nthree (3) other persons.\n(5) The certificate of election for a judicial office sh all be issued to the candidate\nreceiving the highest number of votes, except that if two (2) or more candidates are\nfound to have received the highest and an equal number of votes for the same\noffice, the election shall be determined by lot in the manner t he board directs, in the\npresence of not less than three (3) other persons.","path":["KRS Chapter 118A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=27709","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:16Z","sha256":"c0abe85d46aaac6635c1588658515148c6a339d5f6ba6c00a5ca57352bb27759","source_id":"us-ky","stale":false,"prev":"us-ky/krs-118a.180","next":"us-ky/krs-118a.990"},"notice":"GroundRules: Original legal text.
