{"data":{"id":"us-ky/krs-11a.045","jurisdiction":"us-ky","citation":"KRS 11A.045","heading":"Acceptance  of gifts by public servants permitted under certain","body":"circumstances.\n(1) No  public servant, his spouse, or dependent child knowingly shall accept any\ngifts or gratuities, including travel expenses, meals, alcoholic beverages, and\nhonoraria, totaling a value greater than twenty-five dollars ($25) in a single\ncalendar year from any person or business that does business with, is\nregulated by, is seeking grants from, is involved in litigation against, or is\nlobbying or attempting to influence the actions of the agency in which the public\nservant is employed or which he supervises, or from any group or association\nwhich has as its primary purpose the representation of those persons or\nbusinesses. Nothing contained in this subsection shall prohibit the commission\nfrom authorizing exceptions to this subsection where such exemption would not\ncreate an appearance of impropriety. This subsection shall not apply to:\n(a) Activities involving sponsorships, naming  rights, or similar honoraria\ngranted under KRS 45A.097; or\n(b) Individuals traveling on their own while involved in activities related to\nKRS  45A.097.\n(2) Nothing in KRS  Chapter 11A  shall prohibit or restrict the allocation of or\nacceptance by a public servant of a ticket for admission to a sporting event if\nthe ticket or admission is paid for by the public servant at face value or is paid\nfor at face value by the individual to whom  the ticket is allocated.\n(3) Nothing in KRS  11A.001 to 11A.110 shall prohibit or restrict the acceptance by\na public servant of the Cabinet for Economic Development or by any other\npublic servant working directly with the cabinet on an economic incentive\npackage  of anything of economic value as a gift or gratuity, if the gift or\ngratuity:\n(a) Was  not solicited by the public servant;\n(b) Was  accepted by the public servant in the performance of his or her\nofficial duties and in compliance with guidelines to be established by the\nKentucky  Economic  Development  Partnership which  shall include\nrequirements that all gifts or gratuities of a reportable value under KRS\n11A.050(3)(k) be registered with the Kentucky Economic Development\nPartnership and with the Executive Branch Ethics Commission and that\nall tangible property with a value in excess of twenty-five dollars ($25),\nother than food and beverages consumed  on the premises, shall be\nturned over to the Cabinet for Economic Development within thirty (30)\ndays of receipt. In filing reports of gifts or gratuities with the Executive\nBranch Ethics Commission, the Cabinet for Economic Development may\ndelete information identifying the donors  if the cabinet believes\nidentification of the donors would damage economic development; and\n(c) Was  not accepted under circumstances which would create a violation of\nKRS  Chapter 521.","path":["KRS Chapter 11A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47027","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:28Z","sha256":"65f8b571b2dea29c49b8b1431522e37eb0064055da0b040e791bebe41f606cc0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-11a.040","next":"us-ky/krs-11a.047"},"notice":"GroundRules: Original legal text.
