{"data":{"id":"us-ky/krs-11a.047","jurisdiction":"us-ky","citation":"KRS 11A.047","heading":"Definitions -- Transition team to promote orderly transfer of executive","body":"power and continuity in conduct of state government -- Executive Branch\nEthics Commission to establish in administrative regulations standards of\nethical conduct for transition team members -- Access to and confidentiality of\nnonpublic information -- Disclosure of positions held outside state government\n-- Financial conflicts of interest -- Standards of ethical conduct to be available\non commission's Web site.\n(1) As used in this section:\n(a) \"Agency\" means any department, program cabinet, division, institution, board,\ncommission, office, or agency of state government;\n(b) \"Nonpublic information\" means information relating to state government that\na transition team member o btains as part of his or her participation on the\ntransition team that such member knows or reasonably should know has not\nbeen made available to the general public, or is otherwise not available for\npublic inspection under KRS 61.870 to 61.884;\n(c) \"Transition team\" means a team created by a person newly elected to any\noffice listed in KRS 11A.010(9)(a) to (g) to promote the orderly transfer of\nexecutive power and ensure continuity in the conduct of the affairs of state\ngovernment in connection with the ex piration of the term of office for any\nperson elected to the offices listed under KRS 11A.010(9)(a) to (g) and the\nelection and inauguration of another person to serve in any of the offices listed\nin KRS 11A.010(9)(a) to (g); and\n(d) \"Transition team membe r\" means any person designated to serve on a\ntransition team.\n(2) A person newly elected to any office listed in KRS 11A.010(9)(a) to (g) may create\na transition team for the purpose of promoting an orderly transfer of executive\npower and ensuring continui ty in the conduct of affairs of state government by\nrequesting and utilizing information provided by the administration of the outgoing\nofficial that had been elected to any office listed in KRS 11A.010(9)(a) to (g) prior\nto the expiration of his or her term of office.\n(3) The commission shall establish by administrative regulation promulgated under\nKRS Chapter 13A standards of ethical conduct for transition team members. The\nstandards of ethical conduct for transition team members shall include ethics\nrequirements that:\n(a) Apply to all transition team members;\n(b) Address the role of transition team members who are:\n1. Registered lobbyists under KRS 6.801 to 6.829 and KRS 11A.201 to\n11A.246; or\n2. Former lobbyists who were registered under KRS 6.801 to 6.8 29 and\nKRS 11A.201 to 11A.246 during the twelve (12) month period prior to\nbecoming a transition team member.\n(4) Each person elected to an office listed in KRS 11A.010(9)(a) to (g) shall designate a\nperson or persons to lead his or her transition team or transition teams. Persons\ndesignated as transition team leaders shall, on a form prescribed by the commission\nby administrative regulation promulgated under KRS Chapter 13A, submit to the\ncommission:\n(a) A list of all transition team members;\n(b) A description of how transition team members will comply with the\nprovisions contained within this section; and\n(c) Any additions to or departures from the list of transition team members as\nnecessary to provide an accurate and up-to-date list.\n(5) A transition team member shall:\n(a) Seek authorization from the transition team leader designated by the person\nelected to the office listed in KRS 11A.010(9)(a) to (g) to oversee the\ntransition team to which the transition team member is assigned before\nseeking access to any nonpublic information as part of the transition process;\n(b) Keep confidential any nonpublic information provided in the course of the\nduties of the transition team member with the transition team and exclusively\nuse such information for the purposes of the transition; and\n(c) Not use any nonpublic information provided in the course of transition duties,\nin any manner, for personal or private gain of the transition team member or\nany other party at any time during or after the transition.\n(6) A transition team member shall not receive nonpublic information regarding matters\nthat financially impact:\n(a) The transition team member or his or her spouse;\n(b) The transition team member's employer or his or her spouse's employer;\n(c) The transition team member's lobbying clients;\n(d) Any business in which the transition team member or his or her spouse is a\nboard member;\n(e) Any business in which the transition team member or his or her spouse is an\nofficer;\n(f) Any business in which the transition te am member or his or her spouse is an\nowner of five percent (5%) or more of the business; or\n(g) Any provider of non -state sources of funds received by the transition team\nmember related to his or her transition team duties.\n(7) Every transition team member shall disclose prior to serving on the transition team,\nand update as necessary during service on the transition team on a form prescribed\nby the commission by administrative regulation promulgated under KRS Chapter\n13A:\n(a) His or her current employer and the current employer of his or her spouse;\n(b) Any business in which a transition team member or his or her spouse is a\nboard member, an officer, or an owner of five percent (5%) or more of the\nbusiness during the twelve (12) month period prior to becomi ng a transition\nteam member;\n(c) Any non -state sources of funds received for his or her services related to\ntransition team duties;\n(d) All positions the transition team member has held outside of state government\nfor the twelve (12) month period prior to becoming a transition team member,\nincluding both paid and unpaid positions;\n(e) Any contracts that the transition team member or his or her spouse has sought\nor received with state government during the twelve (12) month period prior\nto becoming a transition team member and affirmation that the transition team\nmember and his or her spouse will not seek a contract with a state agency for\nwhich he or she received nonpublic information during the tenure of the\nadministration;\n(f) Whether the transition team member or his or her spouse has accepted any gift\nor payment exceeding twenty -five dollars ($25) or has accepted future\nemployment from any party interested in seeking influence in state\ngovernment during the twelve (12) month period prior to becoming a\ntransition team member, or during service as a transition team member;\n(g) A description of the transition team member's role in the transition, including\na list of any policy issues on which the transition team member is expected to\nwork, and a list of agenc ies with which the transition team member is\nexpected to interact while serving on the transition team;\n(h) Any issues from which each transition team member shall be recused while\nserving as a member of the transition team; and\n(i) An affirmation that eac h transition team member does not have a financial\nconflict of interest that precludes transition team members from working on\nspecified issues to which he or she has been assigned.\n(8) The commission shall make the standards of ethical conduct for transit ion team\nmembers available to the public on its Web site.","path":["KRS Chapter 11A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51292","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:28Z","sha256":"85fec63c66ed7a1f791fba724995dd7e284cbc94ce2257efab8c6f2339166f7a","source_id":"us-ky","stale":false,"prev":"us-ky/krs-11a.045","next":"us-ky/krs-11a.050"},"notice":"GroundRules: Original legal text.
