{"data":{"id":"us-ky/krs-11a.055","jurisdiction":"us-ky","citation":"KRS 11A.055","heading":"Raising of funds for certain activities permitted -- Exemption  from","body":"requirements of chapter for nonprofit charitable organization.\n(1) Any  provision of KRS  Chapter 11A to the contrary notwithstanding, a state\nagency  or a public servant may  raise funds, either individually or as a\ndepartment or agency, for a charitable nonprofit organization granted a tax\nexemption by the Internal Revenue Service under Section 501c of the Internal\nRevenue  Code without violating the provisions of this chapter. Raising of funds\nshall include but not be limited to holding events for the benefit of the charitable\norganization, contacting potential donors, providing prizes, and engaging in\nother forms of fundraising and providing the funds thus raised to the charitable\norganization.\n(2) Any  provision of KRS  Chapter 11A to the contrary notwithstanding, a state\nagency  or a public servant may  raise funds, either individually or as a\ndepartment  or agency, for crime prevention, drug and  alcohol abuse\nprevention, tourism promotion, and traffic safety programs without violating the\nprovisions of this chapter. Raising of funds shall include but not be limited to\nholding events for the benefit of a program specified in this section, contacting\npotential donors, providing prizes, and engaging in other forms of fundraising\nand providing the funds thus raised to the program.\n(3) Any  provision of KRS  Chapter 11A  to the contrary notwithstanding, any\nnonprofit charitable organization organized under 26 U.S.C. sec. 501(c)(3),\naffiliated with the Tourism, Arts and Heritage Cabinet, or whose purpose is the\npromotion of tourism in the Commonwealth:\n(a) Shall not be subject to the provisions of this chapter;\n(b) May  benefit from cabinet employees working on its behalf without the\nemployees violating the provisions of this chapter; and\n(c) May  make  contributions to the cabinet after being solicited by cabinet\nemployees without the employees violating the provisions of this chapter.","path":["KRS Chapter 11A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47028","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:28Z","sha256":"8ec551918139632f3e604295c528dcd43392eb254af1d49eb998d38c721c2a1f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-11a.050","next":"us-ky/krs-11a.060"},"notice":"GroundRules: Original legal text.
