{"data":{"id":"us-ky/krs-12.040","jurisdiction":"us-ky","citation":"KRS 12.040","heading":"Heads of departments -- Appointment of executive directors by Governor.","body":"(1) The heads of departments shall have direction and control of their respective\ndepartments, and through their departments shall exercise the powers and perform\nthe duties vested in the departments under their direction and control. Except as\notherwise expressly provided by law, the heads of departments shall be appointed\nby the Governor for terms not exceeding four (4) years on the basis of their merit\nand fitness to perform the duties of their respective offices.\n(2) Each department head shall maintain a pa ttern of organization capable of receiving\nthe attachment of administrative bodies that have functions related to the general\nfunction of his department.\n(3) Within the resources of his department, each department head shall provide\nadministrative bodies i n his department with such facilities and services as will\nenable those bodies to carry out the functions with which they are charged.\n(4) The heads of all departments shall exercise supervision over the personnel and\nfinancial records of their respective departments.\n(5) In case of a vacancy or in the absence or disability of the head of a department, the\nGovernor may authorize the head of a division or other administrative officer to act\nas head of the department.\n(6) When required by statute to appoint t he head of an office, the Governor shall\nappoint an executive director for a term not exceeding four (4) years on the basis of\nmerit and fitness to perform the duties of the office.","path":["KRS Chapter 12"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=630","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:28Z","sha256":"7b39f85e1de3ff73249a8349408a949a3ce83a1b00f986d96e0a41bc94a01851","source_id":"us-ky","stale":false,"prev":"us-ky/krs-12.035","next":"us-ky/krs-12.050"},"notice":"GroundRules: Original legal text.
