{"data":{"id":"us-ky/krs-12.245","jurisdiction":"us-ky","citation":"KRS 12.245","heading":"Administrative bodies to issue occupational license, permit, or certificate to","body":"members of the United States military, Reserves, or National Guard, veterans,\nand spouses of members and veterans holding similar license, permit, or\ncertificate from other jurisdictions.\n(1) An administrative body that issues a license, permit, certificate, or other document\nrequired to operate within a business, profession, or other occupation in the\nCommonwealth shall issue within thirty (30) days of receipt of a completed\napplication a license, permit, certificate, or other document to a member of the\nUnited States military, Reserves, or National Guard, or to his or her spouse, or to a\nveteran or the spouse of a veteran, who is seeking a license, permit, certifi cate, or\nother document and currently holds or recently held equivalent documentation\nissued by another state, the District of Columbia, or any possession or territory of\nthe United States unless:\n(a) The license, permit, certificate, or other document iss ued by another state, the\nDistrict of Columbia, or any possession or territory of the United States has\nbeen expired for more than two (2) years;\n(b) The license, permit, certificate, or other documentation is not in good\nstanding;\n(c) The holder of the li cense, permit, certificate, or other document has had the\nlicense, permit, certificate, or other document suspended for disciplinary\nreasons; or\n(d) The board can show substantive evidence of significant statutory deficiency in\nthe training, education, or experience of the United States military service\nmember, Reserves or National Guard member, veteran, or spouse, which\ncould cause a health or safety risk to the public.\n(2) The United States military service member, Reserves or National Guard member,\nveteran, or spouse shall submit:\n(a) Proof of issuance of a valid license, permit, certificate, or other document\nissued by another state, the District of Columbia, or any possession or\nterritory of the United States that is active or has been expired for less than\ntwo (2) years;\n(b) Proof that the valid license, permit, certificate, or other document issued by\nanother state, the District of Columbia, or any possession or territory of the\nUnited States is in good standing or was upon the date of expiration; and\n(c) 1. His or her DD-214 form or other proof of active or prior military service\nwith an honorable discharge, discharge under honorable conditions, or a\ngeneral discharge under honorable conditions; or\n2. Military orders documenting his or her transfer to a military assignment\nin Kentucky.\n(3) A United States military service member, Reserves or National Guard member,\nveteran, or spouse who holds a license, permit, certificate, or other document issued\nby a nother state, the District of Columbia, or any possession or territory of the\nUnited States who applies for a license, permit, certificate, or other document\npursuant to subsection (1) of this section and is denied shall have the right to appeal\nthe decision in accordance with KRS Chapter 13B.\n(4) A United States military service member, Reserves or National Guard member,\nveteran, or spouse who holds a license in multiple jurisdictions through an interstate\nlicensure compact, with respect to services that h e or she provides within the\njurisdiction of the interstate licensure compact, shall be subject to the requirements\nof the compact or applicable statutes and not this section.","path":["KRS Chapter 12"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55098","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:29Z","sha256":"7333e4eb0142ad8c6ab85dbc53487b4bae5f7d956ed298635724355fe16d43cd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-12.240","next":"us-ky/krs-12.250"},"notice":"GroundRules: Original legal text.
