{"data":{"id":"us-ky/krs-12.455","jurisdiction":"us-ky","citation":"KRS 12.455","heading":"Legislative findings.","body":"(1) The General Assembly recognizes that many persons with disabilities and their\nfamilies receive some level of support and services that are funded or administered\nby state agencies. The support and services are provided to persons with disabilities\nor their families, if appropriate, either directly or through arrangements with local\ncommunity-based vendors, organizations, or agencies.\n(2) The General Assembly recognizes that persons with disabilities who receive the\nservices and support, directly or indirect ly, are often not consulted for their\nperspectives, nor are their viewpoints sought regarding the efficiency, strengths, or\nweaknesses of the services and support.\n(3) Persons with disabilities and their families face obstacles in the court system\nthrough lack of understanding and difficulty of access.\n(4) Various agencies in state government promulgate standards that govern the\nadministration or operation of the services and support. Seldom are persons with\ndisabilities or their families involved in the de velopment of standards that directly\naffect the quality of the services and support that they receive. In addition, there are\nlegislative commissions that serve in an advisory capacity concerning the services\nprovided to persons with disabilities and their families, whose membership does not\ninclude persons with disabilities and their families.\n(5) It is the finding of the General Assembly that:\n(a) Some forms of discrimination against persons with disabilities continue.\nThese persons are a discrete minorit y who have been faced with restrictions\nand limitations, subjected to a history of purposeful unequal treatment, and\nrelegated to a position of political powerlessness in our society;\n(b) Persons with disabilities and their families have a significant cont ribution to\nmake in the decision -making processes that shape the support and services\nthey receive through state government;\n(c) Persons with disabilities and their families should be provided with\nmeaningful opportunities to contribute their perspectives through their\nexperiences concerning issues relating to services, support, and standards that\nultimately affect them;\n(d) Services and support should be responsive and sensitive to the cultural, racial,\nage, language, and gender characteristics of persons with disabilities and their\nfamilies; and\n(e) Meaningful opportunities to contribute their perspectives will help provide\nadequate information in a manner that facilitates and allows for participation\nby persons with disabilities and their families.","path":["KRS Chapter 12"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=679","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:29Z","sha256":"e2a335345d3771995627ce4e96f9a13e5c38a765f0126e4b27f7c0fdfa3c52d3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-12.450","next":"us-ky/krs-12.460"},"notice":"GroundRules: Original legal text.
