{"data":{"id":"us-ky/krs-12.461","jurisdiction":"us-ky","citation":"KRS 12.461","heading":"Employment in state agency decision -making positions and participation in","body":"programs consistent with the Federal Americans with Disabilities Act --\nDisability awareness program.\nTo ensure that Kentuckians with disabilities and their families enjoy full partnership in all\nprograms, services, and activities throughout the Commonwealth:\n(1) Consistent with this subsection, consideration shall be given to persons with one (1)\nor more disabilities for employment in decision -making positions in every program,\ncabinet, department, and agency of state government. Persons with one (1) or more\ndisabilities shall not be discriminated against and shall be given an equal\nopportunity to be employed in decision-making positions in every program, cabinet,\ndepartment, and agency of state government consistent with and to the extent\nrequired by the Federal Americans with Disabilities Act;\n(2) Individuals with disabilities shall be given equal opportunity to participate in the\nprograms, services, and activities of state gover nment consistent with and to the\nextent required by the Federal Americans with Disabilities Act;\n(3) If not already a part of staff development training for state government, a program\nshall be developed within the Personnel Cabinet containing a disability  awareness\ncomponent;\n(4) Consistent with this subsection, consideration shall be given to persons with one (1)\nor more disabilities for employment in decision -making positions in any\ncommunity-based agency that receives funds from any executive cabinet or  any of\nits subdivisions. Persons with one (1) or more disabilities shall not be discriminated\nagainst and shall be given an equal opportunity to be employed in decision -making\npositions in any community -based agency that receives funds from any executive\ncabinet or any of its subdivisions consistent with and to the extent required by the\nFederal Americans with Disabilities Act;\n(5) If program evaluation criteria is utilized by any community -based agency that\nreceives funds from any executive cabinet or any  of its subdivisions for its\nprograms, services, and activities, the criteria may include in the measures of\nperformance, the number of individuals served by the program, service, or activity;\n(6) Individuals with disabilities shall be given equal opportun ity to participate in the\nprograms, services, and activities of community -based agencies that receive funds\nfrom any executive cabinet or any of its subdivisions consistent with and to the\nextent required by the Federal Americans with Disabilities Act;\n(7) If a community-based agency that receives funds from any executive cabinet or any\nof its subdivisions engages in staff development and training, that community-based\nagency shall include a program with a disability awareness component;\n(8) If a community-based agency that receives funds from any executive cabinet or any\nof its subdivisions utilizes program evaluation criteria, those criteria may include in\nany measures of performance, the number of individuals served by the program,\nservice, or activity.","path":["KRS Chapter 12"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=681","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:29Z","sha256":"fb64b9ffb1ada01372b2e212c55499935089d4027234f27d3d9877e03be9fd96","source_id":"us-ky","stale":false,"prev":"us-ky/krs-12.460","next":"us-ky/krs-12.465"},"notice":"GroundRules: Original legal text.
