{"data":{"id":"us-ky/krs-12.550","jurisdiction":"us-ky","citation":"KRS 12.550","heading":"Governor's Council on Wellness and Physical Activity -- Membership --","body":"Powers and duties -- Reports.\n(1) The Governor's Council on Wellness and Physical Activity is hereby established\nand authorized to operate the Governor's Wellness and Physic al Activity Program,\nInc. for the purpose of establishing and implementing a health, wellness, and fitness\nprogram for Kentucky and to promote a healthy lifestyle for all citizens of the\nCommonwealth. The Governor's Council on Wellness and Physical Activit y shall\nbe attached to the Department for Public Health for administrative purposes.\n(a) The ex officio members of the Governor's Council on Wellness and Physical\nActivity shall be as follows:\n1. The Governor or the Governor's designee from the executive cabinet;\n2. The secretary of the Cabinet for Health and Family Services or\ndesignee;\n3. The secretary of the Personnel Cabinet or designee;\n4. The secretary of the Education and Labor Cabinet;\n5. The Senate co -chair of the Interim Joint Committee on Health Services\nof the General Assembly; and\n6. The House co -chair of the Interim Joint Committee on Health Services\nof the General Assembly.\n(b) In addition to the ex officio members, the Governor shall appoint five (5)\ncouncil members to serve three (3) year terms on the Governor's Council on\nWellness and Physical Activity. Members appointed by the Governor may be\nreappointed by the Governor to se rve successive terms. In making\nappointments, the Governor shall attempt to include individuals from different\ngeographic regions of the Commonwealth of Kentucky. The Governor shall\nmake appointments to fill vacancies as they occur. Each appointment after the\ninitial appointment shall be for a three (3) year term unless the appointment is\nto fill the unexpired portion of a term.\n(c) The Governor or, if so designated by the Governor, the chairman of the\ncouncil shall have the authority to hire, fire, and man age all personnel of the\nGovernor's Wellness and Physical Activity Program, Inc., including the\nexecutive director.\n(d) The council shall administer funds appropriated or gifts, donations, or funds\nreceived from any source. The council may expend funds in its discretion to\ncarry out the intent of KRS 12.020, 12.023, and 12.550.\n(e) The council shall closely coordinate with the Department for Public Health to\nestablish policies and procedures.\n(f) The council shall select from its membership a chairman and a ny other\nofficers it considers essential. The council may have committees and\nsubcommittees as determined by the council.\n(g) The council shall make recommendations to the Governor and secretary of the\nCabinet for Health and Family Services.\n(h) The council shall meet quarterly or more often as necessary for the conduct of\nits business. A majority of the members shall constitute a quorum for the\ntransaction of business. Members' designees shall have voting privileges at\ncommittee meetings.\n(i) Members of th e council shall serve without compensation but shall be\nreimbursed for their necessary travel expenses actually incurred in the\ndischarge of their duties on the council, subject to Finance and Administration\nCabinet administrative regulations.\n(j) The council may establish working groups as necessary.\n(k) The council shall establish the Governor's Wellness and Physical Activity\nProgram, Inc. pursuant to the requirements in KRS 12.020, 12.023, and\n12.550.\n(2) Funds appropriated for purposes of the program sh all not lapse at the end of the\nfiscal year.\n(3) (a) The Governor's Wellness and Physical Activity Program, Inc. shall follow\nstandard accounting practices and shall submit the following financial reports\nto the Office of the Governor, the Finance and Admi nistration Cabinet, and\nthe Legislative Research Commission:\n1. Quarterly reports of expenditures of state funds, submitted on or before\nthe thirtieth day after the end of each quarter in the corporation's fiscal\nyear;\n2. Annual reports of receipts and exp enditures for the Governor's Wellness\nand Physical Activity Program, Inc., submitted on or before the sixtieth\nday after the end of the fiscal year of the corporation; and\n3. The report of an annual financial audit conducted by an independent\nauditor, submitted on or before September 1 of each year.\n(b) The Governor's Wellness and Physical Activity Program, Inc. shall file\nquarterly reports with the Office of the Governor and the Legislative Research\nCommission. The report shall include a detail of the operations of the program\nfor the preceding year. The report shall include information concerning the\nparticipant demographics, number of incentives distributed, and program\noutcomes according to such measures of success as the board may adopt.","path":["KRS Chapter 12"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53675","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:29Z","sha256":"ad993c54678e8ca213a69982adbf08a03e70e38dbbcf86b3e7d0e1fb28e76c04","source_id":"us-ky","stale":false,"prev":"us-ky/krs-12.520","next":"us-ky/krs-120.005"},"notice":"GroundRules: Original legal text.
