{"data":{"id":"us-ky/krs-120.075","jurisdiction":"us-ky","citation":"KRS 120.075","heading":"Appeal to Court of Appeals from judgment in primary contest.","body":"(1) Any party may appeal to the Court of Appeals from a judgment entered under KRS\n120.065. The appeal shall be in accordance with the Rules of Civil Procedure,\nexcept that the notice of appeal shall be filed and a supersedeas bond executed in\nthe Circuit Cour t, and the record shall be filed in the Court of Appeals, within ten\n(10) days after the entry of the judgment, or within such other time as the Court of\nAppeals may, for cause shown, permit. The entire original record shall be filed and\nno designation of record shall be required.\n(2) Upon the filing of the record, the clerk of the Court of Appeals shall immediately\ndeliver it to the chief judge.\n(3) The Court of Appeals in its discretion may issue its mandate forthwith after\nrendering its decision, but it shall be without prejudice to the right of the losing\nparty to file a petition for rehearing or the power of the court to recall the mandate\nshould the petition be sustained.\n(4) If the judgment is reversed and the case remanded for trial or further action , the\nproceedings shall continue in the Circuit Court in like manner as when originally\nfiled, beginning ten (10) days after the filing of the mandate with notice to the\nadverse party.","path":["KRS Chapter 120"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=27814","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:18Z","sha256":"52eb8c1275520c83064d5a52aedefab12d885959f00d3df1dc5d7ff083bb8058","source_id":"us-ky","stale":false,"prev":"us-ky/krs-120.071","next":"us-ky/krs-120.076"},"notice":"GroundRules: Original legal text.
