{"data":{"id":"us-ky/krs-120.155","jurisdiction":"us-ky","citation":"KRS 120.155","heading":"Contest of regular election of officers other than Governor, Lieutenant","body":"Governor, General Assembly member and certain city officers.\n(1) Any candidate for election to any state, county, district or city office (except the\noffice of Governor, Lieutenant Governor, member of the General Assembly, and\nthose city offices as to which there are other provisions made by law for\ndetermining contest elections), for whom a number of votes was cast equal to not\nless than twenty -five percent (25%) of the n umber of votes cast for the successful\ncandidate for the office, may contest the election of the successful candidate, by\nfiling a petition in the Circuit Court of the county where the contestee resides,\nunless the officer is one (1) elected by the voters of the whole state, in which case\nthe petition shall be filed in the Franklin Circuit Court.\n(2) (a) The petition shall be filed and process issued within thirty (30) days after the\nday of election.\n(b) The petition shall state the grounds of the contest r elied on, and no other\ngrounds shall afterwards be relied upon.\n(3) (a) The contestee shall file an answer within twenty (20) days after the service of\nsummons upon him or her.\n(b) The answer may consist of a denial of the averments of the petition and may\nalso set up grounds of contest against the contestant; if grounds are so set up\nthey shall be specifically pointed out and none other shall thereafter be relied\nupon by the party.\n(4) Any candidate who would have been qualified to bring a contest action u nder this\nsection, who is a party to a requested recount proceeding under KRS 120.185(1),\nmay, by filing answer in the recount proceeding within the time allowed by this\nsection for filing grounds of contest, set forth grounds of contest against the\npetitioner in the recount proceeding.\n(5) A reply may be filed within ten (10) days after the answer is filed; its affirmative\nallegations shall be treated as controverted, and no subsequent pleading shall be\nallowed.","path":["KRS Chapter 120"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51723","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:18Z","sha256":"58eacb19990b4b34ccfa973fc36ed6b939677ce212729edf698d8a80e1bf5a3e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-120.150","next":"us-ky/krs-120.157"},"notice":"GroundRules: Original legal text.
