{"data":{"id":"us-ky/krs-121.252","jurisdiction":"us-ky","citation":"KRS 121.252","heading":"Political issues committee treasurer and persons making independent","body":"expenditures -- Duties relating to activity of foreign national -- Restrictions --\nPresumption of violation.\n(1) Upon a political issues committee's receipt of a contribution , the treasurer shall\nobtain from the donor an affirmation that the donor is not a foreign national and has\nnot knowingly or willfully accepted funds aggregating in excess of one hundred\nthousand dollars ($100,000) from a foreign national during the four ( 4) years\nimmediately preceding the date the contribution was made.\n(2) The treasurer of a political issues committee shall affirm in its report that the donor\nassociated with each contribution is not a foreign national and has not knowingly or\nwillfully re ceived, solicited, or accepted, whether directly or indirectly,\ncontributions or expenditures aggregating in excess of one hundred thousand dollars\n($100,000) from a foreign national during the four (4) years immediately preceding\nthe date the contribution was made.\n(3) Within forty-eight (48) hours of making an independent expenditure supporting or\nopposing a ballot measure, the person or entity making the expenditure shall:\n(a) Certify to the registry that the person or entity has not knowingly or willful ly\naccepted funds aggregating in excess of one hundred thousand dollars\n($100,000) from a foreign national for four (4) years immediately preceding\nthe date the expenditure was made, and that it will not do so through the\nremainder of the calendar year in which the ballot measure will appear on the\nballot; and\n(b) Affirm in the person's or entity's report that the person or entity has not\nknowingly or willfully accepted funds aggregating in excess of one hundred\nthousand dollars ($100,000) from a foreign na tional during the four (4) years\nimmediately preceding the date the expenditure was made.\n(4) Any determination that an entity required to file one (1) or more certifications under\nsubsection (1) or (3)(a) of this section has accepted funds aggregating in excess of\none hundred thousand dollars ($100,000) from one (1) or more foreign nationals\nduring the four (4) years immediately preceding the date the contribution or\nindependent expenditure at issue was made shall create a presumption that the\nperson or political issues committee has violated this section.","path":["KRS Chapter 121"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56181","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:18Z","sha256":"a3e1a7e3b870e9e9b71c17b22f0fa4ef8e1eadd9c311d984d0cfab3f35622e00","source_id":"us-ky","stale":false,"prev":"us-ky/krs-121.250","next":"us-ky/krs-121.254"},"notice":"GroundRules: Original legal text.
