{"data":{"id":"us-ky/krs-134.129","jurisdiction":"us-ky","citation":"KRS 134.129","heading":"Registration for sale of certificates of delinquency with Department of","body":"Revenue.\n(1) Any person who, in any calendar year:\n(a) Pays or plans to pay directly, indirectly, or through another or others, more\nthan five (5) certificates of delinquency statewide;\n(b) Pays or plans to pay directly, indirectly, or through another or others, more\nthan three (3) certificates of delinquency in any county; or\n(c) Invests or plans to invest directly, indirectly, or through another or others,\nmore than ten thousand dollars ($10,000) in the payment of certificates of\ndelinquency on a statewide basis in any calendar year;\nshall register with the department annually.\n(2) The person shall hold a certificate of registration from the department prior to the\npayment of any  certificate of delinquency that results in the person owning more\nthan five (5) certificates of delinquency statewide, more than three (3) certificates of\ndelinquency in any county, or investing more than ten thousand dollars ($10,000) in\nthe payment of certificates of delinquency statewide in a calendar year.\n(3) The department shall promulgate administrative regulations to establish registration\nrequirements and an application process, which may include the imposition of an\nadministrative fee to offset the cost of processing and reviewing the application.\n(4) As part of the application process, the department may require that the applicant and\nany of its directors, officers, members, and managers:\n(a) Are current and in good standing on all taxes owed to the Commonwealth;\n(b) Are in good standing with regard to operations under a previously issued\ncertificate of registration;\n(c) Have not previously operated without obtaining a certificate of registration\nunder this section under circumstances where he or she should have\nregistered; and\n(d) Have a satisfactory record with the Office of Consumer Protection within the\nOffice of the Attorney General. What constitutes a satisfactory record shall be\ndetermined by the department through the promulgation of an adm inistrative\nregulation.\nAny applicant failing to meet one (1) or more of these requirements may be denied a\ncertificate of registration.\n(5) (a) The department may decline to issue a certificate of registration to any\napplicant who does not meet the requi rements established by this chapter and\nthe administrative regulations promulgated thereunder.\n(b) The department may suspend or revoke a certificate of registration if the\nperson holding the certificate violates the provisions  of this chapter or the\nadministrative regulations promulgated thereunder.","path":["KRS Chapter 134"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=40082","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:25Z","sha256":"577ac8561dfd731176efbfba171bb1209474ec20f41e040b38cc405d530aa65f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-134.128","next":"us-ky/krs-134.130"},"notice":"GroundRules: Original legal text.
