{"data":{"id":"us-ky/krs-138.205","jurisdiction":"us-ky","citation":"KRS 138.205","heading":"Prohibited acts by licensees and manufacturers -- Acting without license.","body":"(1) Any licensee under KRS 138.195 who violates any provision of KRS 138.130 to\n138.205, or any administrative regulation promulgated under them, shall become\nindebted to the Commonwealth in the sum of five hundred dollars ($500) for each\nviolation. The civil penalty may be collected by action in the Franklin Circuit Court.\n(2) Any manufacturer who fails to keep written records, and submit reports to the\ndepartment, as required by the provisions of subsection (10) of KRS 138.195, shall\nbecome indebted to the Commonwealth in the sum of one thousand dollars ($1,000)\nfor each violation. The penalty may be enforced by action of the Franklin Circuit\nCourt.\n(3) Any manufacturer doing business within this state without having complied with\nthe provisions of KRS Cha pter 271B as to designation of process agent shall, by so\ndoing of business, be deemed to have made the Secretary of State its agent for the\nservice of process in any civil action instituted in the Franklin Circuit Court for the\nrecovery of the penalty. In  any action, the complaint shall set forth the post office\naddress of the home office of the manufacturer.\n(4) Any nonresident person licensed under the provisions of KRS 138.195 shall, at the\ntime of application for license, designate some resident of thi s state as a process\nagent for the purpose of service of civil process in any civil action originating in any\ncourt of this Commonwealth, and service upon the person so designated shall be\nsufficient to bring the nonresident person before any court of this  Commonwealth\nfor all purposes.\n(5) Any person acting in the capacity of a licensee under the provisions of KRS\n138.130 to 138.205 without having secured a license as provided in KRS 138.195\nshall be subject to the uniform civil penalties imposed pursuant to KRS 131.180 and\ninterest at the tax interest rate as defined in KRS 131.010(6) from the date due until\nthe date of payment.","path":["KRS Chapter 138"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=28691","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:29Z","sha256":"153f977b74e24f92216e49b1fd3fbcd5d50ecdf15b9083950c6b886c2be73d4f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-138.200","next":"us-ky/krs-138.207"},"notice":"GroundRules: Original legal text.
