{"data":{"id":"us-ky/krs-138.320","jurisdiction":"us-ky","citation":"KRS 138.320","heading":"Procurement of dealer's or transporter's license -- Grounds for refusal --","body":"Nonassignability -- Records -- Suspension or revocation.\n(1) To procure the license required by KRS 138.310, every dealer or transporter so\nrequired shall file with the Department o f Revenue an application in such form and\ncontaining such information as the department may deem necessary.\n(2) If the dealer or transporter is a corporation organized under the laws of another\nstate, it shall file with its application a certified copy of the certificate or license\nissued by the Secretary of State of this state showing that the corporation is\nauthorized to transact business in this state.\n(3) At the time of filing application for a license, a financial instrument in the amount\nprovided for in KRS 138.330 shall be filed with the department. No license shall be\nissued upon any application unless accompanied by this financial instrument.\n(4) If application for such a license is filed by any person whose license has at any time\npreviously been canceled for cause by the department, or if the department is of the\nopinion that the application is not filed in good faith, or that the application is filed\nby some person as a subterfuge for the real person in interest whose license or\nregistration has p reviously been canceled for cause by the department, the\ndepartment may, after a hearing of which the applicant has been given five (5) days'\nnotice in writing, and in which the applicant shall have the right to appear in person\nor by counsel and present testimony, refuse to issue a license to that person.\n(5) The application in proper form having been accepted for filing, and the financial\ninstrument having been accepted and approved, the department shall issue to the\napplicant a license, subject to cancellation as provided by KRS 138.340. The license\nshall not be assignable, and shall be valid only for the person in whose name it is\nissued, and shall be displayed conspicuously in the principal place of business of the\ndealer in this state.\n(6) The department shall keep and file all applications and financial instruments, with\nan alphabetical index thereof, together with a record of all licensed dealers or\ntransporters. The department shall publish and keep currently up to date a list of\nlicensed dealers and  transporters, and transmit a copy of list and all revisions\nthereof to all licensed dealers and transporters.\n(7) All licenses shall be valid and remain in full force and effect until suspended or\nrevoked for cause or otherwise canceled.","path":["KRS Chapter 138"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44020","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:29Z","sha256":"817c991bc6385c25f09c03bd59d91fef0a4e16c8ebe9740385f1efba24aaf391","source_id":"us-ky","stale":false,"prev":"us-ky/krs-138.310","next":"us-ky/krs-138.321"},"notice":"GroundRules: Original legal text.
