{"data":{"id":"us-ky/krs-138.511","jurisdiction":"us-ky","citation":"KRS 138.511","heading":"Definitions for KRS 138.510 to 138.550.","body":"As used in KRS 138.510 to 138.550:\n(1) \"Advanced deposit account wagering\" has the same meaning as in KRS 230.210;\n(2) \"Advanced deposit account wagering license\" has the same meaning as in KRS\n230.210;\n(3) \"Association\" has the same meaning as in KRS 230.210;\n(4) \"Corporation\" means the Kentucky Horse Racing and Gaming Corporation;\n(5) \"Daily average live handle\" means:\n(a) The handle from wagers made at a track on live racing during the fiscal year,\nexcluding amounts wagered:\n1. At a receiving track;\n2. At a simulcast facility;\n3. On telephone account wagering;\n4. Through advance deposit account wagering;\n5. At a track participating as a receiving track or simulcast facility\ndisplaying simulcasts and conducting interstate wagering as permitted\nby KRS 230.3771 and 230.3773; and\n6. Beginning April 1, 2014, on historical horse races;\ndivided by:\n(b) The total number of days that live racing was conducted at the track during\nthe fiscal year;\n(6) \"Department\" means the Department of Revenue;\n(7) \"Fiscal year\" means a time frame beginning 12:01 a.m. July 1, and ending 12\nmidnight June 30;\n(8) \"Handle\" means total wagers made on a race;\n(9) (a) \"Historical horse race\" means any horse race that:\n1. Was previously run at a licensed pari -mutuel facility in the Unite d\nStates;\n2. Concluded with official results; and\n3. Concluded without scratches, disqualifications, or dead-heat finishes.\n(b) As used in this subsection, the terms \"pari -mutuel,\" \"scratch,\"\n\"disqualification,\" and \"dead heat\" have the same meaning as est ablished by\nthe corporation pursuant to an administrative regulation promulgated under\nKRS Chapter 13A;\n(10) \"Host track\" has the same meaning as in KRS 230.210;\n(11) \"Interstate wagering\" has the same meaning as in KRS 230.210;\n(12) \"Intertrack wagering\" has the same meaning as in KRS 230.210;\n(13) \"Kentucky resident\" means:\n(a) An individual domiciled within this state;\n(b) An individual who maintains a place of abode in this state and spends, in the\naggregate, more than one hundred eighty -three (183) days of the taxable year\nin this state; or\n(c) An individual who lists a Kentucky address as his or her principal place of\nresidence when applying for an account to participate in advance deposit\naccount wagering;\n(14) \"Receiving track\" has the same meaning as in KRS 230.210;\n(15) \"Simulcast facility\" has the same meaning as in KRS 230.210;\n(16) \"Takeout\" means that portion of the handle which is distributed to persons other\nthan those making wagers;\n(17) \"Telephone account wagering\" has the same meaning as in KRS 230.210; and\n(18) \"Track\" has the same meaning as in KRS 230.210.","path":["KRS Chapter 138"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=54682","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:30Z","sha256":"95d057960e8b83086c354a9d10d4e641867c90f56721d2a4911fd9fa6f6797c7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-138.510","next":"us-ky/krs-138.512"},"notice":"GroundRules: Original legal text.
