{"data":{"id":"us-ky/krs-139.200","jurisdiction":"us-ky","citation":"KRS 139.200","heading":"Imposition of sales tax.","body":"A tax is hereby imposed upon all retailers at the rate of six percent (6%) of the gross\nreceipts derived from:\n(1) Retail sales of:\n(a) Tangible personal property, regardless of the method of delivery, made within\nthis Commonwealth; and\n(b) Digital property regardless of whether:\n1. The purchaser has the right to permanently use the property;\n2. The purchaser's right to access or retain the property is not permanent;\nor\n3. The purchaser's right of use is conditioned upon continued payment; and\n(2) The furnishing of the following services:\n(a) The rental of a ny room or rooms, lodgings, campsites, or accommodations\nfurnished by any hotel, motel, inn, tourist camp, tourist cabin, campgrounds,\nrecreational vehicle parks, or any other place in which rooms, lodgings,\ncampsites, or accommodations are regularly furni shed to transients for a\nconsideration. The tax shall not apply to rooms, lodgings, campsites, or\naccommodations supplied for a continuous period of thirty (30) days or more\nto a person;\n(b) Sewer services;\n(c) The sale of admissions, except:\n1. Admissions to enter the grounds or enclosure of any track licensed\nunder KRS Chapter 230 at which live horse racing or historical horse\nracing is being conducted under the jurisdiction of the Kentucky Horse\nRacing and Gaming Corporation;\n2. Admissions taxed under KRS 229.031;\n3. Admissions that are charged by nonprofit educational, charitable, or\nreligious institutions and for which an exemption is provided under KRS\n139.495; and\n4. Admissions that are charged by nonprofit civic, governmental, or other\nnonprofit orga nizations and for which an exemption is provided under\nKRS 139.498;\n(d) Prepaid calling service and prepaid wireless calling service;\n(e) Intrastate, interstate, and international communications services as defined in\nKRS 139.195, including the furnishing of pay telephone service as defined in\nKRS 139.195;\n(f) Distribution, transmission, or transportation services for natural gas that is for\nstorage, use, or other consumption in this state, excluding those services\nfurnished:\n1. For natural gas that is clas sified as residential use as provided in KRS\n139.470(7); or\n2. To a seller or reseller of natural gas;\n(g) Landscaping services, including but not limited to:\n1. Lawn care and maintenance services;\n2. Tree trimming, pruning, or removal services;\n3. Landscape design and installation services;\n4. Landscape care and maintenance services; and\n5. Snow plowing or removal services;\n(h) Janitorial services, including but not limited to residential and commercial\ncleaning services, and carpet, upholstery, and window  cleaning services;\n(i) Small animal veterinary services, excluding veterinary services for equine,\ncattle, poultry, swine, sheep, goats, llamas, alpacas, ratite birds, buffaloes, and\ncervids;\n(j) Pet care services, including but not limited to grooming an d boarding\nservices, pet sitting services, and pet obedience training services;\n(k) Industrial laundry services, including but not limited to industrial uniform\nsupply services, protective apparel supply services, and industrial mat and rug\nsupply services;\n(l) Non-coin-operated laundry and dry cleaning services;\n(m) Linen supply services, including but not limited to table and bed linen supply\nservices and nonindustrial uniform supply services;\n(n) Indoor skin tanning services, including but not limited to  tanning booth or\ntanning bed services and spray tanning services;\n(o) Non-medical diet and weight reducing services;\n(p) Extended warranty services;\n(q) Photography and photofinishing services;\n(r) Telemarketing services;\n(s) Public opinion and research polling services;\n(t) Lobbying services;\n(u) Executive employee recruitment services;\n(v) Website design and development services;\n(w) Website hosting services;\n(x) Facsimile transmission services;\n(y) Private mailroom services, including:\n1. Presorting mail and packages by postal code;\n2. Address barcoding;\n3. Tracking;\n4. Delivery to postal service; and\n5. Private mailbox rentals;\n(z) Bodyguard services;\n(aa) Residential and nonresidential security system monitoring services, e xcluding\nseparately stated onsite security guard services;\n(ab) Private investigation services;\n(ac) Process server services;\n(ad) Repossession of tangible personal property services;\n(ae) Personal background check services;\n(af) Parking services;\n1. Including:\na. Valet services; and\nb. The use of parking lots and parking structures; but\n2. Excluding any parking services at an educational institution;\n(ag) Road and travel services provided by automobile clubs as defined in KRS\n281.010;\n(ah) Condominium time-share exchange services;\n(ai) Rental of space for meetings, conventions, short -term business uses,\nentertainment events, weddings, banquets, parties, and other short -term social\nevents;\n(aj) Social event planning and coordination services;\n(ak) Leisure, recreational, and athletic instructional services;\n(al) Recreational camp tuition and fees;\n(am) Personal fitness training services;\n(an) Massage services, except when medically necessary;\n(ao) Cosmetic surgery services;\n(ap) Body modification services, including tattooing, piercing, sca rification,\nbranding, tongue splitting, transdermal and subdermal implants, ear pointing,\nteeth pointing, and any other modifications that are not necessary for medical\nor dental health;\n(aq) Laboratory testing services, excluding laboratory testing:\n1. For medical, educational, or veterinary reasons; or\n2. Required by a federal, state, or local statute, regulation, court order, or\nother government-related requirement;\n(ar) Interior decorating and design services;\n(as) Household moving services;\n(at) Specialized design services, including the design of clothing, costumes,\nfashion, furs, jewelry, shoes, textiles, and lighting;\n(au) Lapidary services, including cutting, polishing, and engraving precious\nstones;\n(av) Labor and services to repair or maintain com mercial refrigeration equipment\nand systems when no tangible personal property is sold in that transaction\nincluding service calls and trip charges;\n(aw) Labor to repair or alter apparel, footwear, watches, or jewelry when no\ntangible personal property is sold in that transaction;\n(ax) Prewritten computer software access services; and\n(ay) Data brokering services.","path":["KRS Chapter 139"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58186","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:31Z","sha256":"94fa6f4ba967f73b8fa722d43e372206cb767cb969c7b9f7727a79e941bf6a6b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-139.195","next":"us-ky/krs-139.202"},"notice":"GroundRules: Original legal text.
