{"data":{"id":"us-ky/krs-139.537","jurisdiction":"us-ky","citation":"KRS 139.537","heading":"Exemption for coal-based near zero emission power plant.","body":"(1) As used in this section, \"coal -based near zero emission power plant\" means a\nfacility designed to achieve minimum emissions, built in Kentucky for\ndemonstrating the feasibility of producing electricity and hydrogen from coal,\nwhose site has been determined  acceptable from an environmental impact\nperspective in a record of decision published by the United States Department of\nEnergy after January 1, 2006, and that has received all applicable local planning and\nzoning approvals.\n(2) Notwithstanding all other provisions of this chapter, effective July 1, 2006, the\ntaxes imposed by this chapter shall not apply to the sale, rental, storage, use, or\nother consumption of tangible personal property used to construct, repair, renovate,\nor upgrade a coal -based near ze ro emission power plant, including repair and\nreplacement parts purchased for the plant.\n(3) The Cabinet for Economic Development, with input from the Energy and\nEnvironment Cabinet, shall establish standards for making applications for the\nexemptions prov ided in this section. Prior to the Cabinet for Economic\nDevelopment granting approval, the Office of the Budget Director shall determine if\nthe power plant results in a net positive economic impact to the Commonwealth and\nshall provide a certification in w riting to the Cabinet for Economic Development.\nThe Cabinet for Economic Development shall notify the department in writing that\na power plant has qualified for the exemptions.\n(4) The Cabinet for Economic Development may promulgate administrative regulations\nnecessary to administer the application and certification process of this section.\n(5) The department may promulgate administrative regulations necessary to administer\nthe exemptions provided in this section.\n(6) The provisions of this section shall no t apply to sales or purchases made after\nDecember 31, 2030.","path":["KRS Chapter 139"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=28921","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:32Z","sha256":"4d962f8be7a70c7d41ee534095c77af1eb53064b5ec9bc3bfcb2b3bc0eb2c14d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-139.536","next":"us-ky/krs-139.538"},"notice":"GroundRules: Original legal text.
