{"data":{"id":"us-ky/krs-139.680","jurisdiction":"us-ky","citation":"KRS 139.680","heading":"Procedure in case of failure to withhold.","body":"(1) If the purchaser of a business or stock of goods fails to withhold the purchase price\nas required, he becomes personally liable for the payment of the amount required to\nbe withheld by him to the extent of the purchase price, valued in money. Within\nsixty (60) days after receiving a written request from the purchaser for a certificate,\nor within sixty (60) days from the date the former owner's records are made\navailable for audit, whichever period expires the later, but in any event not later\nthan ninety (9 0) days after receiving the request, the department shall either issue\nthe certificate or mail notice to the purchaser at his address as it appears on the\nrecords of the department of the amount that must be paid as a condition to issuing\nthe certificate.\n(2) Failure of the department to mail the notice will release the purchaser from any\nfurther obligation to withhold the purchase price as above provided.\n(3) The time within which the obligation of a successor may be enforced shall start to\nrun at the time the retailer sells out his business or stock of goods or at the time that\nthe determination against the retailer becomes final, whichever event occurs the\nlater.","path":["KRS Chapter 139"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=28943","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:32Z","sha256":"3459c171e14ca7b720127503cc0ffdb421ff028825385060240df3a0a3ce0b81","source_id":"us-ky","stale":false,"prev":"us-ky/krs-139.670","next":"us-ky/krs-139.690"},"notice":"GroundRules: Original legal text.
