{"data":{"id":"us-ky/krs-13a.120","jurisdiction":"us-ky","citation":"KRS 13A.120","heading":"Promulgation of administrative regulations -- Prohibitions concerning","body":"promulgations.\n(1) (a) An administrative body may promulgate administrative regulations to\nimplement a statute only when the act of the General Assembly creating or\namending the s tatute specifically authorizes the promulgation of\nadministrative regulations or administrative regulations are required by federal\nlaw, in which case administrative regulations shall be no more stringent than\nthe federal law or regulations.\n(b) An administrative body that promulgates an administrative regulation required\nby federal law or federal regulation shall comply with the provisions of this\nchapter.\n(2) An administrative body shall not promulgate administrative regulations:\n(a) When a statute prohib its the administrative body from promulgating\nadministrative regulations;\n(b) When the administrative body is not authorized by statute to promulgate\nadministrative regulations;\n(c) When a statute prohibits the administrative body from regulation of that\nparticular matter;\n(d) When the administrative body is not authorized by statute to regulate that\nparticular matter;\n(e) When a statute prescribes the same or similar procedure for the matter\nregulated;\n(f) When a statute sets forth a comprehensive scheme o f regulation of the\nparticular matter;\n(g) On any matter that is not clearly within the jurisdiction of the administrative\nbody;\n(h) On any matter that is beyond the statutory authorization of the administrative\nbody to promulgate administrative regulations or that is not clearly authorized\nby statute; and\n(i) That modify or vitiate a statute or its intent.\n(3) If a statute requires an administrative body or official to submit an administrative\nregulation to an official or administrative body for review or approval prior to filing\nthe administrative regulation with the commission, the administrative body or\nofficial shall not file the administrative regulation without first having obtained the\nreview or approval.\n(4) Any administrative regulation in violation of this section or the spirit thereof is null,\nvoid, and unenforceable.\n(5) No administrative body, other than the Court of Justice, shall issue rules.\n(6) No administrative body shall issue standards or by any other name issue a document\nof any type where an administrative regulation is required or authorized by law.","path":["KRS Chapter 13A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45153","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:30Z","sha256":"ad7bfe4685987692967209642d3efec3971eb88e54d27732614dd63877c2c966","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13a.110","next":"us-ky/krs-13a.125"},"notice":"GroundRules: Original legal text.
