{"data":{"id":"us-ky/krs-13a.2251","jurisdiction":"us-ky","citation":"KRS 13A.2251","heading":"Information required in administrative regulation when incorporating","body":"material by reference.\n(1) An administrative body shall incorporate material by reference in the last section of\nan administrative regulation. This section shall include:\n(a) The title of the material incorporated by reference placed in quotation marks,\nfollowed by the edition date of the material;\n(b) Information on how the material may be obtained; and\n(c) A statement that the material is available for public inspection and copying,\nsubject to copyright law, at the main, regional, or branch offices of the\nadministrative body, and the address and office hours of each. Following the\nrequired statement, the administrative body shall include information that\nstates the admini strative body's website address or telephone number or that\nprovides contact information for other sources that may have the material\navailable to the public.\n(2) The section incorporating material by reference shall be titled \"Incorporation by\nReference\".\n(a) If only one (1) item is incorporated by reference, the first subsection of the\nsection incorporating material by reference shall contain the following\nstatement: \"(name and edition date of material incorporated) is incorporated\nby reference.\"\n(b) If more than one (1) item is incorporated by reference, the first subsection of\nthe section incorporating material by reference shall contain the following\nstatement: \"The following material is incorporated by reference: (a) (name\nand edition date of first ite m incorporated); and (b) (name and edition date of\nsecond item incorporated).\"\n(c) The second subsection of the section incorporating material by reference shall\ninclude the following statement: \"This material may be inspected, copied, or\nobtained, subject  to applicable copyright law, at (name of administrative\nbody, full address), Monday through Friday, (state the regular office hours).\"\n(3) A summary of the incorporated material shall be attached to an administrative\nregulation that incorporates material by reference. This summary shall include:\n(a) The name and edition date of each item incorporated by reference;\n(b) An explanation of each item and its intended use; and\n(c) The total number of pages incorporated by reference.\n(4) (a) One (1) copy of the material incorporated by reference shall be filed with the\nregulations compiler when the administrative regulation is filed, and:\n1. For material incorporated by reference that was developed by the\npromulgating administrative body:\na. The material incorporated by reference shall be prominently\ndisplayed on the administrative body's website; and\nb. The Uniform Resource Locator (URL) of the address where the\nmaterial may be directly vi ewed on the agency's website shall be\nincluded in the body of the administrative regulation; or\n2. For material incorporated by reference that is subject to a valid\ncopyright owned by a third party not controlled by the promulgating\nadministrative body, th e material shall be referenced by providing\nsufficient information to assist in locating the material from the third\nparty, including the ISBN if available.\n(b) Material incorporated by reference shall be placed in a binder, attached to the\nback of the administrative regulation, filed on a CD-ROM or DVD, or filed in\na different electronic format approved by the regulations compiler.\n1. If the material is placed in a binder, the administrative body shall\nindicate, on the front binder cover and on the first p age of the material\nincorporated by reference, the:\na. Number of the administrative regulation to which the material\nincorporated by reference pertains;\nb. Date on which it is filed; and\nc. Citation of each item that is included in the binder.\n2. The material incorporated by reference may be attached to the back of\nthe administrative regulation if it is:\na. No more than ten (10) pages in length; and\nb. Typewritten on white paper, size eight and one -half (8 1/2) by\neleven (11) inches, and single-sided.\n3. The material incorporated by reference may be filed on a CD -ROM or\nDVD disc if the material is saved in Adobe Portable Document Format\n(PDF). The administrative body shall indicate on the disc and the disc's\nstorage case the:\na. Number of the administrative regulation to which the material\nincorporated by reference pertains;\nb. Date on which it is filed; and\nc. Citation of each item that is included on the disc.\n(c) If the same material is incorporated by reference in more than one (1)\nadministrative regulation, an administrative body may file one (1) copy of the\nmaterial in a binder, on a CD -ROM or DVD disc, or in a different electronic\nformat approved by the regulations compiler.
