{"data":{"id":"us-ky/krs-13a.240","jurisdiction":"us-ky","citation":"KRS 13A.240","heading":"Regulatory impact analysis.","body":"(1) Every administrative body shall prepare and submit to the Legislative Research\nCommission an original and four (4) duplicate copies of a regulatory impact\nanalysis for every administrative regulation when it is filed with the Commission.\nThe regulatory impact analysis shall include the following information:\n(a) The number of the administrative regulation;\n(b) The name, email address, and telephone number of the contact person of the\nadministrative body identified pursuant to KRS 13A.220(6)(d), and, if\napplicable, the name, email address, and telephone number of an alternate\nperson to be contacted with specific questions about the regulatory impact\nanalysis;\n(c) A brief narrative summary of:\n1. What the administrative regulation does;\n2. The necessity of the administrative regulation;\n3. How the administrative regulation conforms to the content of the\nauthorizing statutes; and\n4. How the administrative regulation currently assists or will assist in the\neffective administration of the statutes;\n(d) If this is an amendment to an existing administrative regulation, a brief\nnarrative summary of:\n1. How the amendment will change the existing administrative regulation;\n2. The necessity of the amendment to the administrative regulation;\n3. How the amendment conforms to the content of the authorizing statutes;\nand\n4. How the amendment to the administrative regulation will assist in the\neffective administration of the statutes;\n(e) At least three (3) subject index headings reflecting the content of the\nadministrative regulation selected from a list provided by the regulations\ncompiler;\n(f) The type and number of individuals, businesses, organizations, or state and\nlocal governments affected by the administrative regulation;\n(g) An analysis of how the entities referenced in paragraph (f) of this subsection\nwill be impacted by either the implementation of this administrative\nregulation, if new, or by the change if it is an amendment to an existing\nadministrative regulation. The analysis shall include but not be limited to:\n1. A detailed explanation of the actions the entities referenced in paragraph\n(f) of this subsection will be required to undertake in order to comply\nwith the proposed administrative regulation;\n2. An estimate of the costs imposed on entities re ferenced in paragraph (f)\nof this subsection in order to comply with the proposed administrative\nregulation; and\n3. The benefits that may accrue to the entities referenced in paragraph (f)\nof this subsection as a result of compliance;\n(h) An estimate of ho w much it will cost the administrative body to implement\nthis administrative regulation, both initially and on a continuing basis;\n(i) Whether the administrative regulation or amendment implements legislation\nfrom the previous five (5) years, and if so:\n1. The bill number and year; or\n2. The Kentucky Acts chapter and year;\n(j) The source of the funding to be used for the implementation and enforcement\nof the administrative regulation or amendment;\n(k) An assessment of whether an increase in fees or funding will be necessary to\nimplement this administrative regulation or amendment to an existing\nadministrative regulation;\n(l) A statement as to whether or not this administrative regulation establishes any\nfees or directly or indirectly increases any fees; and\n(m) The tiering statement required by KRS 13A.210.\n(2) The Legislative Research Commission shall review all regulatory impact analyses\nsubmitted by all administrative bodies, and may require any administrative body to\nsubmit background data upon which the information required by subsection (1) of\nthis section is based, and an explanation of how the data was gathered.","path":["KRS Chapter 13A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56292","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:30Z","sha256":"f70006966c71f6d1e1676ee09c959ec581ed412688b5f970387d601bbc781629","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13a.230","next":"us-ky/krs-13a.245"},"notice":"GroundRules: Original legal text.
