{"data":{"id":"us-ky/krs-13a.245","jurisdiction":"us-ky","citation":"KRS 13A.245","heading":"Agencies to prepare a federal mandate analysis comparing proposed state","body":"regulatory standards to federal standards -- Relationship between state\nadministrative regulation and federal law or regulation governing a subject\nmatter.\n(1) (a) When promulgati ng administrative regulations and amending existing\nadministrative regulations in response to a federal mandate, an administrative\nbody shall compare its proposed compliance standards with any minimum or\nuniform standards suggested or contained in the federal mandate.\n(b) Such a comparison shall include, in detail, a written determination by the\nadministrative body on whether the proposed state administrative regulation\nwill impose stricter requirements or other responsibilities on the regulated\nentities than those required by the federal mandate.\n(c) If the administrative body determines that the proposed state administrative\nregulation imposes additional requirements or responsibilities on the regulated\nentities than is required by the federal mandate, the  administrative body shall\ninclude in its comparison analysis a written statement justifying the imposition\nof stricter standards, requirements, or responsibilities.\n(2) (a) Except as provided by paragraph (b) of this subsection, an administrative\nregulation shall conform to a federal law or regulation governing a subject\nmatter if an administrative body is:\n1. Not required by federal law or regulation to promulgate an\nadministrative regulation to comply with a federal law or regulation\ngoverning the subject matter; and\n2. Required or authorized by state law to promulgate an administrative\nregulation governing the subject matter.\n(b) If the administrative regulation is more stringent than or otherwise differs\nfrom the federal law or regulation governing the subject matter, the\nadministrative body shall state in detail in the \"NECESSITY, FUNCTION,\nAND CONFORMITY\" paragraph of the administrative regulation the manner\nin which it is more stringent than or otherwise differs from the federal law or\nregulation, and the reasons therefor.","path":["KRS Chapter 13A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=761","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:30Z","sha256":"c3d5340235f4ab73e1eeb596caf999e991e4bdd029f9b7bcf18b14784def7ebf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13a.240","next":"us-ky/krs-13a.247"},"notice":"GroundRules: Original legal text.
