{"data":{"id":"us-ky/krs-13a.250","jurisdiction":"us-ky","citation":"KRS 13A.250","heading":"Consideration of costs to local and state government and to regulated","body":"entities -- Fiscal note.\n(1) An administrative body that promulgates an administrative regulation shall consider\nthe cost that the administrative regulation may cau se state or local government and\nregulated entities to incur.\n(2) (a) A two (2) part cost analysis shall be completed for each administrative\nregulation.\n(b) The first part of the cost analysis shall include the projected cost or cost\nsavings to the Common wealth of Kentucky and each of its affected agencies,\nand the projected cost or cost savings to affected local governments, including\ncities, counties, fire departments, and school districts.\n(c) The second part of the cost analysis shall include the proje cted cost or cost\nsavings to the regulated entities affected by the administrative regulation.\n(d) Agencies or entities affected by the administrative regulation may submit\ncomments in accordance with KRS 13A.270(1) to the promulgating\nadministrative body or to a legislative committee reviewing the administrative\nregulation.\n(3) Each administrative body that promulgates an administrative regulation shall\nprepare and submit with the administrative regulation a fiscal note. The fiscal note\nshall state:\n(a) The number of the administrative regulation;\n(b) The name, email address, and telephone number of the contact person of the\nadministrative body identified pursuant to KRS 13A.220(6)(d), and, if\napplicable, the name, email address, and telephone number of an alternate\nperson to be contacted with specific questions about the fiscal note;\n(c) Each unit, part, or division of state or local government the administrative\nregulation will affect;\n(d) Whether the administrative regulation was expressly authorized by an act of\nthe General Assembly, and if so, identification of the act;\n(e) In detail, the aspect or service of state or local government to which the\nadministrative regulation relates, including identification of the applicable\nstate or federal statute or regulation that mandates the aspect or service or\nauthorizes the action taken by the administrative regulation;\n(f) The estimated effect of the administrative regulation on the expenditures and\nrevenues of a state or local government agency or regulated entity for the first\nfull year the administrative regulation will be in effect and any s ubsequent\nyear the administrative regulation will be in effect. The administrative body\nshall provide a narrative to explain the fiscal impact of the administrative\nregulation and the methodology and resources it used to determine the fiscal\nimpact; and\n(g) 1. The conclusion of the promulgating administrative body as to whether\nthe administrative regulation will have a major economic impact on state\nand local government and regulated entities for the first full year the\nadministrative regulation will be in effect and for subsequent years if\ndifferent; and\n2. An explanation of the methodology and resources used by the\nadministrative body to reach this conclusion.\n(4) If an administrative body files an amendment to an administrative regulation\npursuant to KRS 13A.320(3) for a legislative committee meeting, the administrative\nbody shall:\n(a) Consider the cost of the amendment as established in subsection (2) of this\nsection; and\n(b) Prepare and submit a fiscal note as established in subsection (3) of this\nsection.\n(5) Any administrative body may request the advice and assistance of the Commission\nin the preparation of the fiscal note.","path":["KRS Chapter 13A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56293","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:30Z","sha256":"bccf15e2df1717ddb02f8a23f157310be14d8bd21f49b04ec8abcc8de5462db5","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13a.247","next":"us-ky/krs-13a.255"},"notice":"GroundRules: Original legal text.
