{"data":{"id":"us-ky/krs-13a.310","jurisdiction":"us-ky","citation":"KRS 13A.310","heading":"Repeal or permissive withdrawal of administrative regulation.","body":"(1) Except as provided in KRS 13A.3102 and 13A.3104, an ordinary administrative\nregulation, once adopted, cannot be withdrawn but shall be repealed if it is\ndesired that it no longer be effective.\n(2) Except as provided in KRS 13A.3102 and 13A.3104, an ordinary administrative\nregulation, once adopted, cannot be suspended but shall be repealed if it is\ndesired to suspend its effect.\n(3) (a) An  ordinary administrative regulation shall be repealed only by the\npromulgation of an administrative regulation that:\n1. Is titled \"Repeal of (state number of administrative regulation to be\nrepealed)\";\n2. Contains the reasons for repeal in the \"NECESSITY,  FUNCTION,\nAND  CONFORMITY\"  paragraph;\n3. Includes in the body of the administrative regulation, a citation to the\nnumber  and title of the administrative regulation or regulations being\nrepealed; and\n4. Meets the filing and formatting requirements of KRS 13A.220.\n(b) 1. Except as provided in subparagraph 2. of this paragraph, on the\neffective date of an  administrative regulation that repeals an\nadministrative regulation, determined in accordance with KRS\n13A.330  or 13A.331, the regulations compiler shall delete the\nrepealed administrative regulation and the repealing administrative\nregulation from the Kentucky Administrative Regulations Service.\n2. If the repealing administrative regulation specifies an effective date\nthat is after the administrative regulation would become  effective\npursuant to KRS  13A.330 or 13A.331, the specified effective date\nshall be considered the effective date of the repealing administrative\nregulation. On the specified effective date, the regulations compiler\nshall delete the repealed administrative regulation and the repealing\nadministrative regulation from  the  Kentucky  Administrative\nRegulations Service.\n(c) An  administrative body may  repeal more than one (1) administrative\nregulation in an  administrative regulation promulgated pursuant to\nparagraph (a) of this subsection if the administrative regulations being\nrepealed  are  contained in the  same  chapter of the  Kentucky\nAdministrative Regulations Service.\n(4) (a) An  ordinary administrative regulation may  be  withdrawn by  the\npromulgating administrative body at any time prior to its adoption.\n(b) An  ordinary administrative regulation that has been found deficient may\nbe withdrawn by the promulgating administrative body or by the Governor\nat any time prior to its adoption.\n(c) Once  an ordinary administrative regulation is withdrawn, it shall not be\nreinstated, except by repromulgation as a totally new matter.\n(5) (a) An  emergency  administrative regulation may  be  withdrawn by the\npromulgating administrative body at any time prior to its expiration.\n(b) An  emergency  administrative regulation that has been found deficient\nmay  be withdrawn by the promulgating administrative body or by the\nGovernor at any time prior to its expiration.\n(6) If an administrative regulation is withdrawn, the administrative body or the\nGovernor shall inform the regulations compiler of the reasons for withdrawal in\nwriting.","path":["KRS Chapter 13A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50637","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:30Z","sha256":"f4ec0c3b82c0263f4b7a97768c711acde1762717bcf6236c5b95d0a5c00777d6","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13a.300","next":"us-ky/krs-13a.3102"},"notice":"GroundRules: Original legal text.
