{"data":{"id":"us-ky/krs-13a.312","jurisdiction":"us-ky","citation":"KRS 13A.312","heading":"Actions required when authority over a subject matter is transferred to","body":"another administrative body or name of administrative body is changed --\nReturn of administrative regulations to previous form if General Assembly\ndoes not confirm or codify executive order.\n(1) If authority over a subject matter is transferred to another administrative body or if\nthe name of an administrative body is changed by statute or by executive order\nduring the interim between regular sessions of the General Asse mbly, the\nadministrative regulations of that administrative body in effect on the effective date\nof the statutory change or the executive order shall remain in effect as they exist\nuntil the administrative body that has been granted authority over the subj ect matter\namends or repeals the administrative regulations pursuant to KRS Chapter 13A.\n(2) After receipt of a written request, submitted pursuant to subsection (3) of this\nsection, to make changes to an administrative regulation pursuant to the statutory\nchange or executive order, the regulations compiler shall alter the administrative\nregulations referenced in subsection (1) of this section to:\n(a) Change the name of the administrative body pursuant to the provisions of the\nstatute or executive order; and\n(b) Make any other technical changes necessary to carry out the provisions of the\nstatute or executive order if the changes do not affect the scope or substance\nof the administrative regulation.\n(3) (a) The administrative body that has been granted statu tory authority over the\nsubject matter shall provide to the regulations compiler in writing and in an\nelectronic format approved by the regulations compiler:\n1. A listing of the administrative regulations that require any changes; and\n2. The specific names , terms, or other information to be changed, marked\nin the complete text of the existing administrative regulation in the\nformat prescribed by KRS 13A.222(2).\n(b) If there are differences between the paper copy and the electronic version, the\nelectronic version shall be the controlling version.\n(4) The administrative body that has been granted statutory authority over the subject\nmatter shall submit new forms to rep lace forms previously incorporated by\nreference in an administrative regulation if the only changes on the form are the\nname and mailing address of the administrative body. If there are additional\nchanges to a form incorporated by reference, the administra tive body shall\npromulgate an amendment to the existing administrative regulation and make the\nchanges to the material incorporated by reference in accordance with KRS\n13A.2255.\n(5) If an administrative body is abolished by statute or executive order and t he\nauthority over its subject matter is not transferred to another administrative body,\nthe Governor, or the secretary of the cabinet to which the administrative body was\nattached, shall promulgate an administrative regulation to repeal the existing\nadministrative regulations that were promulgated by the abolished administrative\nbody. The repeal shall be accomplished as provided by KRS 13A.310.\n(6) If an executive order transfers authority over a subject matter to another\nadministrative body or changes the name of an administrative body during the\ninterim between regular sessions of the General Assembly, and the General\nAssembly does not codify or confirm the executive order during the next regular\nsession, any and all administrative regulations promulgated to implement the\nunconfirmed executive order shall be returned to their previous form by the\nadministrative body using the promulgation procedures established by KRS Chapter\n13A, including but not limited to:\n(a) Withdrawal of a proposed administrative regulation;\n(b) Amendment or repeal of an existing administrative regulation;\n(c) Promulgation of a new administrative regulation; or\n(d) Submission of technical changes in the manner established by subsections (3)\nand (4) of this section.","path":["KRS Chapter 13A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56299","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:30Z","sha256":"b120b635aa8a3fd6bd69c75d4f33df48a0f9b2507537306d82cf1edddd15b105","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13a.3104","next":"us-ky/krs-13a.315"},"notice":"GroundRules: Original legal text.
