{"data":{"id":"us-ky/krs-13a.315","jurisdiction":"us-ky","citation":"KRS 13A.315","heading":"Expiration and withdrawal of administrative regulation prior to review by","body":"legislative committee -- Effect of noncompliance with chapter -- Withdrawal of\ndeficient administrative regulation upon Governor's notification.\n(1) An administrative regulation shall expire and shall not be reviewed by a legislative\ncommittee if:\n(a) It has not been reviewed or approved by the official or administrative body\nwith authority to review or approve, or it does not have a certification required\nby KRS 13A.105(3);\n(b) The statement of consideration and, if applicable, the amended after\ncomments version are not filed on or before a deadline specified by this\nchapter;\n(c) The administrative body:\n1. Has failed to comply with the provisions of this chapter gover ning the\nfiling of administrative regulations, the public hearing and public\ncomment period, or the statement of consideration; or\n2. Has failed to comply with KRS 13A.105; or\n(d) The administrative regulation is deferred pursuant to KRS 13A.300(2) more\nthan twelve (12) times.\n(2) (a) An administrative regulation that has been found deficient by a legislative\ncommittee shall be withdrawn immediately if, pursuant to KRS 13A.330, the\nGovernor has determined that it shall be withdrawn.\n(b) The Governor shall notify the regulations compiler in writing that he or she\nhas determined that the administrative regulation found deficient shall be\nwithdrawn.\n(c) The written withdrawal of an administrative regulation governed by the\nprovisions of this  subsection shall be made in a letter to the regulations\ncompiler in the following format: \"Pursuant to KRS 13A.330, I have\ndetermined that (administrative regulation number and title) shall be\n(withdrawn, or withdrawn and amended to conform to the finding  of\ndeficiency, as applicable). The administrative regulation, (administrative\nregulation number and title), is hereby withdrawn.\"\n(d) An administrative regulation governed by the provisions of this subsection\nshall be considered withdrawn upon receipt by the regulations compiler of the\nwritten withdrawal.","path":["KRS Chapter 13A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56300","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:30Z","sha256":"230442870f98d6ac89e7346ced8f0808c0a292f8e0ba4ad8bd4e51b5052e83ff","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13a.312","next":"us-ky/krs-13a.320"},"notice":"GroundRules: Original legal text.
