{"data":{"id":"us-ky/krs-13a.330","jurisdiction":"us-ky","citation":"KRS 13A.330","heading":"Notification of finding of deficiency -- Governor's determination after","body":"finding of deficiency.\n(1) (a) If a filed ordinary administrative regulation has been found deficient, the\nlegislative committee shall transmit to the Governor and the regulations\ncompiler:\n1. A  copy of the finding of deficiency and other relevant findings,\nrecommendations, or comments; and\n2. A  request that the Governor determine whether the administrative\nregulation shall:\na. Be withdrawn;\nb. Be  amended  at a legislative committee meeting pursuant to\nKRS  13A.320 to conform to the finding of deficiency; or\nc. Become  effective pursuant to the provisions of this section\nnotwithstanding the finding of deficiency.\n(b) The Governor shall transmit his or her determination to the Commission\nand the regulations compiler.\n(c) A  filed ordinary administrative regulation that has been found deficient\nshall be considered as adopted and become effective after:\n1. a. The  review period established in this chapter has  been\ncompleted; and\nb. The  regulations compiler has  received the  Governor's\ndetermination that the administrative regulation shall become\neffective pursuant  to  the  provisions of  this section\nnotwithstanding the finding of deficiency; or\n2. The  legislative committee  that found the filed administrative\nregulation deficient subsequently determines that it is not deficient in\naccordance with KRS  13A.335, provided that this determination was\nmade  prior to receipt by the regulations compiler of the Governor's\ndetermination.\n(2) (a) If an emergency administrative regulation has been found deficient, the\nlegislative committee finding it deficient shall transmit to the Governor and\nthe regulations compiler:\n1. A  copy of the finding of deficiency and other relevant findings,\nrecommendations, or comments; and\n2. A  request that the Governor determine whether the emergency\nadministrative regulation shall:\na. Be withdrawn;\nb. Be  amended  at a legislative committee meeting pursuant to\nKRS  13A.320 to conform to the finding of deficiency; or\nc. Remain  effective as  established in  KRS  13A.190(4)\nnotwithstanding the finding of deficiency.\n(b) The Governor shall transmit his or her determination to the Commission\nand the regulations compiler.\n(c) The  legislative committee that found the emergency  administrative\nregulation deficient may subsequently determine that it is not deficient in\naccordance with KRS 13A.335.\n(3) If an effective ordinary administrative regulation has been found deficient by a\nlegislative committee, the legislative committee shall transmit to the Governor a\ncopy  of its finding of deficiency and other findings, recommendations, or\ncomments  it deems appropriate.","path":["KRS Chapter 13A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=50641","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:30Z","sha256":"539274bb0cc77c54cd46d91415fc797bf4cce6e1dd7b8a2e175a32d568dbaece","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13a.320","next":"us-ky/krs-13a.331"},"notice":"GroundRules: Original legal text.
