{"data":{"id":"us-ky/krs-13a.339","jurisdiction":"us-ky","citation":"KRS 13A.339","heading":"Unenforceability of certain administrative regulations that became","body":"effective notwithstanding finding of deficiency.\n(1) The General Assembly finds that certain administrative regulations as evidenced by\nthe records of the Legislative Research  Commission, including but not limited to\nthe Kentucky Administrative Regulations Service and the Administrative Register\nof Kentucky, were found deficient but became effective notwithstanding the finding\nof deficiency, pursuant to KRS 13A.330, on or after  April 15, 2020, and before\nJanuary 5, 2021, and were found deficient pursuant to KRS 13A.336 including:\n(a) 803 KAR 2:180, Labor Cabinet, Department of Workplace Standards,\nRecordkeeping, reporting, statistics;\n(b) 921 KAR 3:025, Cabinet for Health and Fa mily Services, Department for\nCommunity Based Services, Technical requirements; and\n(c) 921 KAR 3:025E, Cabinet for Health and Family Services, Department for\nCommunity Based Services, Technical requirements, emergency.\n(2) Contrary provisions of any secti on of the Kentucky Revised Statutes\nnotwithstanding, each administrative regulation referenced in subsection (1) of this\nsection shall be null, void, and unenforceable as of June 29, 2021.\n(3) Contrary provisions of any section of the Kentucky Revised Stat utes\nnotwithstanding, the administrative body shall be prohibited from promulgating an\nadministrative regulation that is identical to, or substantially the same as, any of the\nadministrative regulations referenced in subsection (1) of this section for a pe riod\nbeginning on March 30, 2021, and concluding on June 1, 2022.\n(4) A list of the administrative regulations referenced in subsection (1) of this section\nshall be available to the public, in the office of the Legislative Research\nCommission's regulations compiler.","path":["KRS Chapter 13A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51401","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:30Z","sha256":"985617b6cf7cde9af535edb7364f762e7caa84d74a8180dc4fdbb9f25391580e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13a.338","next":"us-ky/krs-13a.340"},"notice":"GroundRules: Original legal text.
