{"data":{"id":"us-ky/krs-13a.3441","jurisdiction":"us-ky","citation":"KRS 13A.3441","heading":"Unenforceability of proposed amendment to 803 KAR 25:190, relating to","body":"utilization review and medical bill audits, as of April 14, 2022.\n(1) The General Assembly finds that a proposed amendment of 803 KAR 25:190,\nrelating to utilization review an d medical bill audits, filed with the Commission on\nFebruary 18, 2021, by the Department of Workers' Claims, was found deficient on\nor after March 30, 2021, and before January 4, 2022, but determined to become\neffective notwithstanding the finding of defic iency pursuant to KRS 13A.330, as\nevidenced by records of the Legislative Research Commission.\n(2) Contrary provisions of any section of the Kentucky Revised Statutes\nnotwithstanding:\n(a) If the proposed amendment of 803 KAR 25:190 referenced in subsection  (1)\nof this section has not been adopted on or before April 14, 2022, the proposed\namendment shall expire as of April 14, 2022; or\n(b) If the proposed amendment of 803 KAR 25:190 referenced in subsection (1)\nof this section has been adopted on or before April 14, 2022, 803 KAR 25:190\nshall be null, void, and unenforceable as of April 14, 2022.\n(3) Contrary provisions of any section of the Kentucky Revised Statutes\nnotwithstanding, the administrative body shall be prohibited from promulgating an\nadministrative regulation that is identical to, or substantially the same as, the\nproposed amendment of 803 KAR 25:190 referenced in subsection (1) of this\nsection for a period beginning on January 4, 2022, and concluding on June 1, 2023.\n(4) The proposed amendment r eferenced in subsection (1) of this section shall be\navailable to the public, in the office of the Legislative Research Commission's\nregulations compiler.","path":["KRS Chapter 13A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56780","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:31Z","sha256":"40b4655980989f7d07267e00fec6f4f2cce1e914ec60e1c0f1bfa9c89bf4f29f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13a.344","next":"us-ky/krs-13a.3442"},"notice":"GroundRules: Original legal text.
