{"data":{"id":"us-ky/krs-13b.110","jurisdiction":"us-ky","citation":"KRS 13B.110","heading":"Recommended order.","body":"(1) Except when a shorter time period is provided by law, the hearing officer shall\ncomplete and submit to the agency head, no later than sixty (60) days after receiving\na copy of the official record of the proceeding, a written recommended order which\nshall include his findings of fact, conclusion of law, and recommended disposition\nof the hearing, including recommended penalties, if any. The recommended order\nshall also include a statement advising parties fully of their exception and appeal\nrights.\n(2) If an extension of time is needed by the hearing officer to complete and submit his\nrecommended order to the agency head, the hearing officer shall show good cause\nto the agency head, in writing, and based upon substantial proof, that an extension\nof time is needed.\n(3) If the agency head, after a showing of good cause, grants the hearing officer an\nextension of time:\n(a) The extension shall not exceed thirty (30) days from the date the extension\nwas granted;\n(b) The statement granting the extension shall be inc luded in the record of the\nhearing; and\n(c) Notice of the extension shall be sent to all parties.\n(4) A copy of the hearing officer's recommended order shall also be sent to each party\nin the hearing and each party shall have fifteen (15) days from the dat e the\nrecommended order is mailed within which to file exceptions to the\nrecommendations with the agency head. Transmittal of a recommended order may\nbe sent by regular mail to the last known address of the party.\n(5) The provisions of this section shall not apply in an administrative hearing where the\nhearing officer conducts the hearing in the presence of the agency head who renders\na decision without the recommendation of the hearing officer.","path":["KRS Chapter 13B"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=795","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:31Z","sha256":"87b9a2f9c2d3d2f5bc41788108ef58d094bac48c1aab1bb274ed4be5680e3ac7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-13b.100","next":"us-ky/krs-13b.120"},"notice":"GroundRules: Original legal text.
