{"data":{"id":"us-ky/krs-14.125","jurisdiction":"us-ky","citation":"KRS 14.125","heading":"Federal qualified elementary and secondary education scholarship tax","body":"credit -- Duties -- Administrative regulations -- Fees -- Immunity.\n(1) Pursuant to 26 U.S.C. sec. 25F(g):\n(a) The General Assembly hereby designates itself under state law t o make the\nelection on behalf of the Commonwealth with respect to federal tax benefits\nunder 26 U.S.C. sec. 25F;\n(b) The General Assembly hereby elects that in each calendar year the\nCommonwealth of Kentucky shall:\n1. Participate in the qualified elementar y and secondary education\nscholarship federal tax credit established under 26 U.S.C. sec. 25F, or\nany successor program, for individuals who make qualifying\ncontributions to scholarship granting organizations; and\n2. Identify scholarship granting organizations in the state;\n(c) The Secretary of State is hereby designated under Kentucky law as the sole\nofficial authorized to:\n1. Report the state's election to participate in the qualified elementary and\nsecondary education scholarship federal tax credit under  26 U.S.C. sec.\n25F; and\n2. Submit a list as described in 26 U.S.C sec. 25F(g) and perform other\nfunctions necessary to implement the General Assembly's election under\nparagraph (a) of this subsection; and\n(d) The Secretary of State shall notify the United States Secretary of the Treasury\nof the Commonwealth's participation in the qualified elementary and\nsecondary education scholarship federal tax credit and submit the list\nestablished by the Secretary of State by January 1 of each year.\n(2) The Secretary of State shall publish the associated administrative regulations and\nother applicable guidance issued by the United States Secretary of the Treasury or\nthe Internal Revenue Service on the Secretary of State's website.\n(3) The Secretary of State may promulgate administrative regulations in accordance\nwith KRS Chapter 13A necessary to carry out this section.\n(4) The Secretary of State shall collect a fee from scholarship granting organizations or\naccept private c ontributions to pay the necessary costs of administration of this\nsection. All amounts received under this subsection shall be deposited in a restricted\nfund account, not commingled, and shall be used solely to administer this section.\n(5) Any immunity und er the Eleventh Amendment to the Constitution of the United\nStates is waived under this section.","path":["KRS Chapter 14"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57167","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:31Z","sha256":"1e6016ae4fdfd509bcf65bb0606d9eee4e82dc756d1cb7010bd7f9f9958f87f1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-14.120","next":"us-ky/krs-14.130"},"notice":"GroundRules: Original legal text.
