{"data":{"id":"us-ky/krs-140.170","jurisdiction":"us-ky","citation":"KRS 140.170","heading":"Appraisal of estates -- Appointment, duties and compensation of","body":"appraisers -- Records.\n(1) The District Court, upon the request of the personal representative or any interested\nparty, shall appoint some competent person as appraiser of the estate. The  appraiser\nshall give notice to all persons having an interest in the estate and to such other\npersons as the court may by order direct, and shall then appraise the property\nbelonging to the estate. His report shall be filed with the court and a copy there of\nwith the Department of Revenue. He shall be paid for his services out of the funds\nof the estate, on the certification of the court, the amount to be fixed by that court.\nThe total compensation of the appraiser shall not exceed one -tenth of one percent\n(0.1%) of the total appraised value of the estate for inheritance tax purposes, but\nthere shall be a minimum allowance of five dollars ($5), together with the\nappraiser's actual and necessary traveling expenses.\n(2) After investigation, the department may change the value of the estate for\ninheritance taxes and advise the representatives of the estate of this changed\nvaluation after the receipt of a completed tax return and full payment as shown by\nthe tax return.\n(3) No appraiser shall accept any fee or re ward from a personal representative, trustee,\nlegatee, next of kin or heir of the decedent, or from any other person liable to pay\nthe tax or any portion thereof.\n(4) No person shall willfully and knowingly subscribe to or make any false statement of\nfact, or knowingly subscribe to or exhibit any false paper or false report with intent\nto deceive any appraiser.\n(5) The department shall keep a record of all returns, reports, and schedules attached\nthereto required by this chapter for twelve (12) years.","path":["KRS Chapter 140"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=28997","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:33Z","sha256":"a87e88188762135e5c74980ddbace78eacb719ea3d1fe4e521d6a9c526dfab75","source_id":"us-ky","stale":false,"prev":"us-ky/krs-140.165","next":"us-ky/krs-140.180"},"notice":"GroundRules: Original legal text.
