{"data":{"id":"us-ky/krs-140.220","jurisdiction":"us-ky","citation":"KRS 140.220","heading":"Collection of taxes by personal representative or trustee -- Sale of property","body":"for tax -- Recovery of taxes from trust or life estate property.\n(1) A personal representative or trustee holding property subject to any of the taxes\nlevied by this chapter  shall not deliver the property until he has collected the tax\nthereon.\n(2) When a specific bequest of personal property other than money is subject to the tax\nand the legatee neglects or refuses to pay the tax upon demand, the personal\nrepresentative or t rustee may, upon such notice as the court having jurisdiction of\nthe settlement of the estate may direct, be authorized to sell the property or, if it can\nbe divided, such portion thereof as may be necessary. He shall deduct the tax from\nthe proceeds of th e sale, and account to the legatee for the balance, if any, of the\nproceeds, in lieu of the property.\n(3) The personal representative or trustee shall collect the taxes due upon land or the\nproceeds of insurance policies that are subject to tax from the he irs or devisees\nentitled thereto, and he may be authorized to sell the land if they refuse or neglect to\npay the tax.\n(4) If any trust or life estate is subject to the taxes levied by this chapter by virtue of its\ninclusion in the decedent's estate under KRS 140.100(4), unless the decedent directs\notherwise in his will, the personal representative of the decedent's estate shall be\nentitled to recover from the trust or life estate property that portion of the total taxes\nassessed against the decedent's estat e under this chapter equal to the gross value of\nsuch trust or life estate property at the decedent's death divided by the value of the\ndecedent's entire gross estate, such values to be as finally determined for purposes\nof this chapter.","path":["KRS Chapter 140"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=29002","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:50:33Z","sha256":"d7a82300680462a0bb9a4633da56d73935f0d758134770d274b79b64ea9d0585","source_id":"us-ky","stale":false,"prev":"us-ky/krs-140.210","next":"us-ky/krs-140.222"},"notice":"GroundRules: Original legal text.
